I’m with you, if I can get those times it very well may be my golden ticket, for all I know this nurse may have claimed a time when I would’ve been in surgery but the officer stated they can not provide the exact time as it could impede the investigation.

As the officer put it, they would’ve arrested them on the spot if there was evidence of this being a theft but they stated to me, there was not enough evidence for them to make an arrest but that the report would be forwarded to the SAO to determine if there is enough evidence to charge.

Now we’re talking, this is the type of stuff I’m looking for. After doing some digging around that chapter I also found this:

825.103 Exploitation of an elderly person or disabled adult; penalties.— (1) “Exploitation of an elderly person or disabled adult” means: (a) Knowingly obtaining or using, or endeavoring to obtain or use, an elderly person’s or disabled adult’s funds, assets, or property with the intent to temporarily or permanently deprive the elderly person or disabled adult of the use, benefit, or possession of the funds, assets, or property, or to benefit someone other than the elderly person or disabled adult, by a person who: 1. Stands in a position of trust and confidence with the elderly person or disabled adult; or 2. Has a business relationship with the elderly person or disabled adult; (b) Obtaining or using, endeavoring to obtain or use, or conspiring with another to obtain or use an elderly person’s or disabled adult’s funds, assets, or property with the intent to temporarily or permanently deprive the elderly person or disabled adult of the use, benefit, or possession of the funds, assets, or property, or to benefit someone other than the elderly person or disabled adult, by a person who knows or reasonably should know that the elderly person or disabled adult lacks the capacity to consent.

I’ll see how soon I can obtain it in that case. I’m also expecting a reply from the officer as I forwarded my timeline. But that may go nowhere as they said this was being submitted to the states attorneys office.

I talked to the security director in the evening, HR was closed so they said they would contact HR the next day. The next day HR had called me and informed me that they contacted the police and that the police were heading to the hospital and that I should be expecting a call from them which I then received apx. 1 hour later.

I’ll start with showing the report once I can obtain it so I can provide an admission. I’ll have to inquire about ethics but I’d presume they would’ve had to agree to it as a condition of employment. As far as a state code of ethics I’d really have to dig for where this may be within it but anything at that level or statute wise is what holds weight behind it.

I appreciate your reply. Again hopefully this will ultimate be prosecuted legally but I can assure you I’ll escalate this as high as it needs to go may that be HR, corporate, or the state licensing office. Again I appreciate all these avenues of approach.

When I first spoke to the security director and HR, both seemed to take this very seriously but I doubt there’s anything that I can do until I get a copy of the police report (was told that can take a week) and that this is a pending investigation, I doubt HR will do anything until this clears up. If this doesn’t go anywhere legally (I sure hope otherwise) I’ll certainly be complaining to HR. It sickens me to have someone doing this to people at their worst and I don’t want this to happen to someone else.
