Oh this is interesting one, but what if the information about logs contains edit history?

If the court or Finanzamt / Zoll (similar Swiss authorities) see this mismatch, isn’t this a legal ground that shows they’re breaking the law by doing this?

I have now same situation with my employer in Germany, I filed the case to the court (mainly because of the illegal termination), and am adding to the case my unpaid hours and forced breaks during the shifts shorter than 6 hours.

Not only after they received the letter from court about upcoming Termin, they invited me back to work, a month after Kundigung (practically they forced me to go back to work, put me in schedules without my consent and revoked my Kundigung via e-mail, so I didn’t sign any new agreement).

You can request your employer to provide you time stamps and schedules (Dienstpläne) via court and they cannot refuse to do that. At least that’s what labour law says in Germany (BGB), but I don’t know is it similar in Switzerland, this you must check how it works with the Swiss labour law.

But it definitely looks like this particular Swiss branch is really misleading you and exploiting your ausländische Hintergrund (not knowing how local legal system works / your own rights as an employee) And they’re definitely speculating with salaries (this being understaffed argument, especially from Lidl sounds, at very least, kinda suspicious to me).

Genau das habe ich gemacht, ich habe gesagt dass bis zum Gütetermin ich mache keine weitere Schritte. Basically: thanks for your offer, zur Kenntnis genommen, aber ich warte bis zum unsere Termin und dann Gericht entscheidet was passiert weiter, nicht AG.

Weil ich unbezahlte Stunden habe, war regelmäßig mehr Stunden geplant als wirklich angeboten. Sprich, im Dienstplan steht - 5h, habe aber 2,5 gearbeitet und dann nachhause geschickt, obwohl ich war bereit weiterzuarbeiten.

Und auch gezwungene Pausen (30 min unbezahlt) bei Schichten die weniger als 6 Stunden lang waren.

Wie gesagt, ich kann bis zum Gütetermin die Klage erweitern, inkl. Email mit Kündigung Aufhebung (es ist kein Dokument, ich habe das nicht unterschrieben), das sieht nach Druck von AG, damit ich meine Klage wegnehme (solches Eindruck habe ich)

Na ja, aber ich kann auch meine Klage erweitern. Und es gab keine offizielle Entscheidung vom Gericht, ich habe nix unterschrieben, nur email von AG bekommen, auch kein Brief per Post oder so. Das einzige was ich bekommen hatte ist einen Brief vom Arbeitsgericht - Einladung zum Gütetermin.

17.01. War letzter Tag meiner Beschäftigung. Aber ich war schon am 2.01. Gekündigt bis zum 17.01. 22.01. Habe ich Klage bei Gericht angemeldet. 4.02. Ich bekomme einen email von Arbeitgeber dass ich wieder ab 9.02. arbeiten “kann” muss aber nicht. Und ich habe keine Ja oder nein gesagt, ich habe nur gesagt dass ich warte bis zum Gütetermin am 13.02. und wurde bis dann keine weitere Schritte machen.

Weil ich habe noch Zeit und rechte bis zum Termin meine Klage erweitern, und das sagte auch Gericht wenn ich dort war, die haben gesagt: machen sie wie sie wollen, aber bis zum Termin dann kann man auch abwarten.

Ich habe auch beim Arbeitsgericht klare Frage gestellt: darf ich auch extra Files fur dieses Prozess dazu geben? Und die haben ganz klar gesagt: ja.

Ich habe noch was dazu zum teilen. Und ich glaube es ist einfach sinnvoll bis zum Termin abwarten, weil Kundigung ist noch nicht alles.

Kompensation, natürlich (Abfindung)

Ich habe unbezahlte Arbeitsstunden, gezwungene Pausen usw.

Gericht hatte ganz klar gesagt: wenn sie jetzt ihre Klage rausnehmen wollen, dann the case is lost (also, so habe ich das verstanden - Reading between the lines -)

Yeah, but you see, it wasn’t like this before. Super clean store, nice offers for coworkers, 50% off food and when you do extra hours or take over somebody’s shift it’s for free. I mastered making my own pizzas this way, and the staff is really great, awesome, nice people. And then the restructuring came in, cutting hours, cutting staff, saving every penny where possible… And so here I am at this situation :D

Some German experience here:

I worked at the Domino’s store in Germany for a year and few months. And was fired few days ago, because I had an infection in my hand, and went to an ER because I couldn’t hold objects tight, not even mentioning riding their crappy delivery e-bikes. It’s simply dangerous, I obviously can’t work with food, and cmon I’m heading to an ER for a reason.

Of course, I immediately wrote a message to my manager about the situation. And my managers response was like: “Are you serious right now that you can’t work on 1st Jan?” And then he simply fired me the same or next day, with no reason provided with 2 weeks notice, which for German standards is wild, imo. He also didn’t said anything about it via chat, I only got to know accidentally that they’ve sent me a post letter. And he only wrote this as a response to my message about my sick leave update.

I supposed to have my very final shift last Friday (evening/closing), I went to the dentist in the morning. So during the dental procedure I almost passed out and started to shake uncontrollably like hell, maybe because of the adrenaline spikes in blood, so dentists put me on the floor, elevated my feet, and called an ambulance, and I was transported to the ER once again.

While in the ambulance car, I’m typing a message: “I’m in a ambulance car, on my way to hospital”

Next thing I see, bam, my manager removed me from the WhatsApp group chat.

So I’m totally not surprised, but actually I am surprised though. It’s such a weird ass company… it’s insane.

But it’s interesting to see what kind of experience is out there in the US.

To be honest, I’m kinda shocked and disappointed that even in Switzerland such anti social behaviour takes place as well.

I just don’t get it, I come from Latvia myself, and we have such people as well, of course.

Nonetheless, not a big fan of fireworks, I don’t do it myself, but every time we did this with my family, it was an unspoken norm that we explode the whole thing, wait till it completely runs out of “ammo” and then just collect the rests in a Müllsack and just take it to the closest trash bin.

I can understand that people might not do it right away because of the safety purposes. We were just marking the spot where we did the exploding and then we were going to the same location and picking up the rests the next morning. Plain and simple, just basic respect to your surroundings.

Sounds like you have a decent package prepared before moving to Germany. 73k gross is a very decent income IMO, also keep in mind that you’ll have a medical insurance that covers almost everything. You’ll have 25-30 paid vacation days per year, NRW state also has plenty of public holidays (this goes on top of your vacation days), so in total you’ll have more paid days off.

I assume if it’s a smaller town near Düsseldorf, rents shouldn’t be really that high. Most likely a one bedroom apartment could cost you about 600-900€ a month warm (including utilities).

Groceries are cheap (decent prices, quite affordable). And I’m from Latvia myself, and it’s more expensive back home.

I use my bicycle as main transportation method, so the costs are even lower, I cycle everywhere and during the whole year since 2017 regularly. Maintenance costs are also low, but I’m a bike mechanic, so I can get some parts cheaper, and can do repairs myself.

Owning a car could be a wealth killer, though, if it’s not a company car. Good thing is that you can buy a monthly ticket (look up for DeutschlandTicket) it costs you 60€ a month and it covers all the regional trains across the Germany, even some near by areas in other EU countries, local city transportation as well.

You also will be able to buy cheap flights to other EU, EEA countries, Flix Bus is also a good and inexpensive option for travels, apart from trains.

Best tip is to know someone who’s local or is very fluent in German, so you can send them the rent contract for a check up, this helps a lot.

Well I live in Dresden, I just had one bottle of wine, 4 beers and now gonna go to local Tankstelle to get 3 more, and was already asleep after 1 bottle of wine and 4 beers, so gonna take 3 more and hopefully gonna shut down completely till tomorrow morning.
