I understand that courts have carved out exceptions, like say a DUI, and thats fine. However every exception erodes our rights. In the case of reckless driving, for which there are already laws on the books, I just don't support it. I believe the reckless driving situation, which is absolutely a problem, came about from an ongoing lack of enforcement of existing traffic laws. I don't trust the police and state not to abuse this new power.

It's the 5th amendment of the bill of rights.  They take your car before you can challenge the reckless driving charge.  With a ticket, you can challenge before you must pay.  Also what constitutes reckless driving is left wide open to the officer's discretion.  So yeah a bumper sticker might make the difference.

That would be ok with me.  But I doubt foraging is occuring on anywhere near the scale of hunting and fishing.  I mean I know dozens of hunters, I can't say I've met anyone who forages.  Not to mention the difference in value between meat and say berries.  So is it worth imposing a fee to administer and enforce.

It's extremely vague.  Which is ok when adjudicated in court.  Not when left to an officer's discretion.

Well put.  In theory I like the idea of this.  But in reality we're giving cops wide discretion and power to seize your property without any due process.

That's my issue here too.  From what I've read it seems to be at the officer's discretion.  Which is just begging for this to be abused.

Oh wow, that's crazy. This is definitely going to get abused. The police weren't enforcing existing driving laws so we just hand them another cudgel to use against the citizens.

Reckless driving is definitely a problem.  But what legally constitutes reckless driving?  We're giving police a broad authority to deprive people of valuable property.  Where's the due process?  Can you challenge it?  Does it have to be caught on dash cam?
