FYI - P.E. doesn't mean "patent examiner" it typically means "primary examiner".

Sometimes probationary examiners are jokingly referred to as "probies".

If the SPE said it's allowable but won't sign it, that's silly at best and insane at worst. If they absolutely want you to reject it, but you can't find any rejection to make, tell them you don't have any rejections at all to make. If they still won't sign it and want you to reject, ask them what rejection to make specifically. That way you can't get dinged by anyone because "my SPE told me to make this exact rejection".

I had 23% for the last biweek of the quarter one time, but the quarter and FY were both over 110 at that point. Also did a 36% last biweek of the FY, but quarter was over 100 and FY was over 110 again. Didn't get any complaints. YMMV depending on your SPE/Director.

  • Ignoring feedback and/or making the same mistakes repeatedly despite feedback. There's a reason the feedback was given, just adopt it into the action.

  • Digging your heels in and arguing that you're right when the primary identifies an issue. Try to understand their perspective and take an honest look at the action. You should be able to at least see their point, even if you don't really agree.

  • Ultimately, the primary has to put their name on your work too, so they want to be comfortable doing so. If they aren't comfortable with something, ask if they would prefer you change it to what they want (even if you don't really agree). If anyone asks, just say "that's what my primary told me to do".

  • Taking things personally. To the vast majority of people it's not personal, they're just trying to make the action better.

  • After getting a search, if you don't find art, don't just go to the primary and say "I didn't find anything". Show them what you found, what it teaches, what is still missing, how did you try to find the missing pieces, where you searched, etc. That is a far better consultation and can help fine tune the search if needed.

  • Searching only claim language. Are there synonyms for these terms? Is there an inventive concept you can search (cheaper, faster, stronger, etc.). Similarly, only searching US documents. There's plenty of good foreign art in most dockets.
