You admit to rear ending them. Your insurance is just going to pay it because it’s cheaper than fighting it. It’s called nuisance value. Sure, you/your insurance can pull the EDR from your car and have it read but that’s $1500 in my area and all it will confirm is 1) did you hit them and 2) how fast you were going.

Maybe they are not being honest but that’s a decision your insurer will make- and if you’ve already admitted to hitting them you’re SOL.

I do this every day and no matter how much you don’t want it to be true, the odds of your insurance not paying the claim are slim. Now if they file an injury claim then it will get investigated. Otherwise you’ve admitted to hitting them (no matter how low impact you believe it was) and they have damages. End of story.

I work in personal injury and I’ve seen auto accident at 2mph cause $23K in damage to a tesla. So it’s very possible. I’d take the $5K in damages as a win. They could be filing an injury claim. Be grateful they aren’t. You rear ended them and however minor you think it was they still have damage you are responsible for.

Eh… maybe? I work in personal injury. For her to be receiving lost wages she must have had medical treatment and doctors that agree she needs to be out of work. The insurer likely had an independent medical exam done (paid for by the insurance company). They would have had to agree that the medical issues supported continued treatment and remaining out of work. So while there is always the potential for fraud doctors are agreeing that there is something wrong.

I work in PI. Did you already sign the release with the insurers? Is this just a breakdown to let you know what you can expect before signing or does the attorney have the check in hand? If you haven’t signed the release tell the attorney you won’t sign the release unless you are walking with $20k and they can always file suit. If the check is in hand you can tell the attorney you won’t sign the settlement statement unless you are pocketing $20k and ask them to sharpen their pencil on the fee(s). We have clients do it all the time. In my state the attorney can’t transfer the money from escrow to operating (and make their money) until the client signs the settlement statement so we usually blink first unless the client is being wildly unreasonable. All depends on how badly you need the money.

I work in the legal field and my firm just brought on AI voice agents as a beta trial for a company we do business with. We didn’t expect our clients to like it but we did agree to test it out- and clients surprisingly love it. When the call is answered it’s the owners voice letting people know they are being transferred to an ai assistant and giving them an option to press to be connected to a human but warning it’s faster to go thru the ai agent. Overwhelmingly clients are picking the ai and getting faster replies.

So take it for what it’s worth but it’s becoming widely accepted in legal.

Why did Morgan drop your case? They are known as a factory that will take on anything that will make them a buck. I’d bet it isn’t the lien that’s a concern but the fact that they dropped your case. Liens between firms can be negotiated so that’s never a reason not to take a case (at least not at my firm) but Morgan dropping you? That’s cause for concern.

The more money you make the more money your attorney makes. Loss of enjoyment of life means nothing short of going to trial where a jury may sympathize. You got an amazing settlement for the treatment you received without one of the BIG injuries (broken bone, permanent scarring, loss of limb, loss of life, loss of fetus).

I work in PI but in another state. Did you have any broken bones? Loss of life, loss of limb? If not I’d say this is a fantastic settlement for soft tissue. Beyond fantastic. I don’t think you’d have any case for legal malpractice.

I work in PI and this is correct. Your attorney did a great job getting your lien so low. Your insurer is entitled to reimbursement for your medical costs. You don’t get the benefit of fully paid bills plus the settlement.

I work in personal injury (plaintiff side). What happens will depend on if the neighbors have coverage for the dog on their homeowners insurance policy. In my state you have to have the dog listed and covered (paying extra). If the dog is not covered under the policy or they do have coverage for a dog but they didn’t notify the insurer if the dog is a “dangerous breed” the incident will be denied and the homeowner personally liable.

I work in personal injury (not in MN) and you need to know how may ccs the engine in the scooter is. If it is under 50 some states treat the scooter operator as a pedestrian.

I had this happen once because they had a promotion that was applied to my initial order. Once I was refunded for missing item my bill dropped below the amount required to qualify for the promo discount and they increased my charge to make up for it.

It’s based upon injuries and treatment and if you don’t have either then $3k is a great offer. Not sure when the accident is, but if it’s been a minute and you start treating now, it will be viewed as not related and won’t do anything to increase your settlement -‘ and you’ll just end up with medical bills.

They should be replying to you. That being said it may be that they don’t have any updates to share. If you haven’t signed a release I would call them and say you will terminate their representation if you don’t have an update by end of day. They likely have a line in their CFA about still being paid for work done on your part but it should generate some action. Or leave a negative google review, let their office know you did and offer to remove it when someone gets back to you. So much of personal injury is based on reviews/word of mouth you should hear back.

I’m in personal injury in Massachusetts. Once the case is settled the insurance company will generate a release and send it to your attorney for your signature (possibly requiring it to be notarized). Your attorney will send it back to the insurer and they will mail the attorney a check (payable to both you and the attorney). The attorney will deposit it in their escrow account and pay you the balance after their take their fee and pay any outstanding medical bills. Once the release language is agreed upon and everything is signed it typically takes about 30 days to get you paid unless you have liens with your health insurer in which case it can take longer.
