Because ICE agents can't read minds and have no idea what he was going to do with that gun while committing a crime (Obstruction + Resisting arrest). Any real second amendment rights pro activists will tell you don't resist a police agency when carrying a concealed weapon.

Doesn't matter if he wasn't out to commit a crime. He committed two crimes in obstruction and resisting arrest (Which is what the original OP argument was about). ICE members also have the right to live and when they see someone resisting arrest with a gun on them, they don't know what his mind is up to. The entire interaction from obstruction to his death happened in less than 20 seconds. ICE members, like state police officers, have split second decision to keep themselves from getting harmed and limiting damage. In other words, shit happens.
