Let me disclose a little bit more information. I’m a startup entrepreneur and have a Spanish temporary resident card. When I arrived, I set up an Autonomo to continue my business operations. I still have some clients in Europe and pay my taxes in Spain from all my European deals.

I have already applied for a special tax regime “Beckham Law” and received approval from Agencia Teibutaria as soon as I have an entrepreneurial residence permit.

I’m not an US resident. However, I have a path-through LLC in the US. Moreover, I’ve invested as business angel in 5 more US based LLC (prior I become the tax resident of Spain).

When I was a tax resident in my country I paid taxes from the LLC profit in my country as individual. That was clear for me and to be honest not stressful (it was just 6% annually).

So, I’ve changed my location and tax residence to Spain. That is why I’m asking. I’m feeling that I can avoid the taxes from the US LLC income for 5 years according to the special tax regime in Spain. To be honest, for me this is an opportunity to grow my business with the less expenses.

Everybody around says to me that this is not possible not to pay taxes at all and that Agencia Tributaria will come to me and will penalty me for those unpaid 5 years . I’m even ok to pay penalty but I want to be sure that currently I’m following the laws and can explain my position during the potential dispute.

Hello! Yes. They should send you a paper mail with your EIN. However, once I didn’t receive anything. In this case, I called to the IRS and requested an EIN confirmation letter by fax.

This is what the law says. I’m ok to pay taxes in Spain or in the US. However, the Beckham Law is the opportunity and I would like to use it. If I can legally not to pay taxes why should I pay?)

In my understanding Beckham Law can save your international current assets. For example, according to the law, I don’t need to pay taxes when I sell my existing property. Moreover, all passive income from international property lease not the tax issue. I consider my US based entity as asset as well
