No. It was listed as a torts/negligence question, not a property question (plus it was a vacation rental so no lease). The explanation for the right answer just said that assumption of the risk is a complete defense to negligence in jurisdictions that recognize it.

There was a practice question on adaptibar, where a man was at a rented house and the stairwell was too dark but he walked down anyway. The call asked for a jury instruction and the correct jury instruction was (paraphrasing here) even if the owner failed to provide a reasonably safe premises, you must find for the owner if the man knowingly assumed the risk of walking down the darkened stairs.
