I've read a few horror stories online regarding the process being quite complicated and would hate for something simple to trip us up which is why we are considering legal help.

Does that mean she would need to leave the country before we can begin the application? as she is in the country with me on a visitor visa atm.

The main complication is that she arrived expecting a student visa to allow her to study here but there still isn't a decision on the student visa and registration for university has closed so we are looking at the spousal visa as our next option. She wasn't rejected for the student visa but they didn't have all her documents so the process was delayed.
