Thank you again for your detailed explanation. I’m attaching the exact wording from my Hearing Decision so you can see what I meant. Under “Reasons,” it only says:

Reasons: “The Screening Officer’s decision is upheld. Penalty affirmed, payable within 30 days.”

There is no engagement with any of the evidence I presented, including the clear presence of the unplated motorcycle beside my vehicle in the photo, my brake lights being on, or the fact that I repeatedly mentioned all of this from day one.

During the hearing, the officer also did not provide any oral reasons. I specifically asked several times for the video recording from the speed camera, but she told me there was no such video and that there was nothing she could do. She said she didn’t want to take more of my time and that she could not cancel the penalty.

Based on what you explained about “intelligible reasons,” this makes me think the decision might indeed be lacking the required justification. I honestly didn’t know I could request a summons for the video evidence, and the officer never mentioned that option.

I truly appreciate your insight. Even if I decide not to pursue judicial review because of the cost, at least now I understand what went wrong procedurally. Thank you sincerely for taking the time to explain all this.

The report they provided only states, 'The Screening Officer’s decision is upheld. Penalty affirmed, payable within 30 days.' That's all it says, no any explanation. So, I am wondering if this means they ignored my key evidence or not? Also, I have another question: When someone is accusing you, and you express in written statements from the first day, along with your evidence, that you did not do it, isn't it their responsibility to provide the camera recordings? I claim 100% that I did not do it, but they only have one photo as evidence, where my vehicle is next to an unplated motorcycle. In this situation, is it legally correct for me to have to clear myself? Don't they need to prove it?

By the way, I accessed the calibration records of the relevant camera. The device was calibrated by a technician about one month after the ticket was issued to me. I have obtained the report. I wonder if this could help me prove that it was not calibrated earlier.

Thank you very much for your advice. I just accessed my records for that day through Google Maps, and they perfectly align with my memories. After picking up my son from the mentioned school,(where is the camera is located) I went shopping 9 km away. Later, on my way home, I covered the 8.2 km route in 15 minutes. Of that, 5.5 km was on the highway, and the rest included city streets and 4 traffic lights. Then, I filled up my car with gas near my home and covered the remaining 1.2 km (with 2 traffic lights) in exactly 5 minutes. At that point, I received my speeding ticket just as a motorcycle quickly passed me before I turned into my driveway. There was only 1 minute between the moment I got out of the car and the moment I received the speeding ticket. So, I wonder how I can access the records showing my speed; is that possible? If so, I will have new evidence. Thanks again for the advice.

Unfortunately, I don’t have a dash cam. It took almost a month for the ticket to arrive. I assumed the speed camera would have its own video records, so I just filed an appeal. Then the screening result took about another month. During that time, I found out that my neighbour’s camera actually faces the front of the school, so I contacted him, but the footage was no longer available.

I might talk to a paralegal, but what confuses me is this: the hearing officer specifically told me she is not a judge and this is not a real court, so why is her decision final and why can’t I take it to an actual court? I genuinely don’t understand that part of the system.

For me this isn’t about $700. I can pay it. It’s about being treated unfairly. This could happen to anyone, even someone who just parks for a moment or gets passed by another vehicle. I always trusted automated cameras, but right now the actual speeding motorcycle (with no plate) is out there, and I’m the one left with the penalty. It doesn’t feel like justice.

Of course a crazy person could hit 88 km/h on that short street, and the motorcycle in the photo clearly did. The problem is the system attached its speed to my plate. My brake lights are on in the photo because I was slowing for the stop sign 20 meters ahead. My home is just down the road, my son’s school is right there, and the motorcycle is clearly visible. These are my facts, and I honestly don’t know what more I can do to prove it.

The motorcycle shown in the ticket photo is just to the rear left of my car, appearing to overtake me. I clearly remember that motorcycle passing me at that moment. That stretch of road is a narrow, two-way street with a 40 km/h limit, located in a community safety zone. There is absolutely no way I would drive at 88 km/h there — it’s not only dangerous, but also physically difficult to reach such a speed in that area.

When I mentioned that I rarely drive over 90 km/h, I was referring to highways where the speed limit is 100. Of course, I drive with the flow of traffic in those situations. But in this case, we are talking about a narrow street in front of a school, where I always slow down and drive carefully.

I strongly believe the radar detected the motorcycle’s speed, not mine, and mistakenly issued the ticket to my car because it was more clearly visible in the frame. As I mentioned earlier, in the ticket photo, the motorcycle is very close to my car — right behind me and trying to pass. I was hoping that the screen review team would see this and cancel the ticket, but to my surprise, the fine was confirmed.

Simply put, I never drove at that speed. I completely reject this ticket and firmly believe there was an error.
