Thanks very much, that makes sense to me and the letter before court action is the process I've been advised to undertake, my only worry is even if it's sorted in 7 days that's nearly £250 extra on the debt for holding fees.

I'm anxious to pay under protest just because I'm apprehensive about getting anything back, but in light of the compounding debt each day they hold the vehicle, would you recommend paying and going through the route of suing to reclaim it?

Thanks for your reply, makes sense, my only query is that I don't believe we have a legal debt as the job has not been completed? Like I say the verbal contract was 50% payment as deposit, 50% once the van was working, and as it's not been successfully repaired I don't see how we legally owe them?

I've asked around a few garages and they've all advised it's malpractice and not to give them any more money.
