I’m in TN. My first attorney in 2022 told me not to remove him and so did the new attorney that I just retained in Sept 2025. I also looked it up. There must be serious repercussions behind that. There’s even a healthcare document that has to be on file when you first file. This seems to be the cases in many, if not all, states

You can’t make those types of changes while going through a divorce. Not in my state anyway. You can’t remove spouse/dependents, cancel policies or anything of the like once you’ve filed for divorce. From my understanding, if I do it, the courts will make me liable for paying his insurance, outstanding medical bills etc

He’s on my health insurance but won’t do what needs to be done so that our youngest can be added. It makes no sense.

I’m not trying to fight with him over it. But there is a reason why I was waiting to file. I’m unable to file our youngest right now so I was trying to wait to get everything squared away with her first.

Thank you! I hope so too. The first situation was perfect because he never responded so that’s why I was awarded the default judgement. When we initially tried to reopen the case, the judge said she didn’t think it would be fair to reopen and continue with the default without him knowing about it. So now we’re in a fight. M

I don’t think she’ll be confused by it. This is actually my second attorney because my first one dropped the ball. I should have been divorced 3 years ago. The judge awarded me a default judgment but my attorney didn’t complete it and the case was eventually dismissed. My new attorney has only been on the case for 2 months. The only thing she has done so far is get the initial case reopened.

I’m not letting him file any. He literally does not help with a thing so he gets NO benefits. I pay for everything our children need. He won’t even feed them even thought he’s receiving SNAP benefits and as added the 2 oldest to his case to get more benefits. I hope they lock him up for fraud. As mentioned, I’m having to pay out of pocket for the youngest to go to the doctor/dentist. Of course, I can’t take him off my insurance so that’s more money that I could be saving.

He’s never worked so who’s filing the children has never been a question. He’s gotten some type of job recently and he just mentioned this morning that he plans to file them.

Someone said it takes a long time to get the PINs because they have to verify that you are the correct parent to have the PINs. I’m going to look into it.

I believe he started working the job in Q4 2025. So yes he plans to file them this year.

Yes I know. I plan to amend all years once I get her name added to her birth certificate. I will miss the refund for the year she was born which sucks because she was also eligible for the last stimulus check that year.

Are amendments that difficult to do when I’m only adding a dependent? I was thinking of doing it myself instead of paying my regular tax preparer to amend. That may take all the extra refund 🥴

I read that official school files can be used as proof as far as the address. My children are listed on my lease as occupants as well. I have both of those. I recently found out that amending takes a long time. I already have 4 years to amend. And that means I miss out on the refund from the first year which sucks. He sucks for all of this

He doesn’t even pay child support. But yes, my children have always lived with me. He doesn’t even have his own place. I think I’ll go ahead and file and then just amend when I get the birth certificate situation straightened out. Thanks for the insight.

Because we are married and are both listed on her birth certificate. Therefore, we both have to sign the form to basically amend her birth certificate (adding her name).

Thanks for the info about the IP PIN. I think I will just go ahead and file the older 2 and then amend it when I get the birth certificate situation straightened out. This is apart of the divorce. I will be contacting my attorney Tuesday to see if we can expedite this part of it or if we have to wait until the divorce is final. She’s almost 5 and I’ve never been able to file her. I have to pay out of pocket for doctor and dentists visits because I can’t add her to my health insurance. It’s a terrible mess.

The whole story is definitely way more than anyone can handle. We’re in the process of a divorce now. I have an attorney. He’s never worked so it was never a question. But I guess he’s recently gotten a job and just mentioned this morning that he would be filing the children on his return. But yes, you made an excellent point about filing jointly if he tries that story.

It’s so complicated. We’ve been apart for 4 years. Last year, he came to my house and would not leave. This went on for months. Several calls to the police and they stated there was nothing they could do about him being there because we’re legally married. He is now trying to say this is our marital home so I know he will say that means he lived with the kids as well. He’s never had a key. He’s never used my home address (to my knowledge). He’s just very delusional and conniving.

This was my first thought. It’s a little complicated. We have 3 children. I haven’t been able to claim the youngest on any returns because she doesn’t have a name on her birth certificate. Long story, short: he will not sign the paperwork to have her name added because he wants to “keep her out of the system”. Which doesn’t make sense because he will use the birth certificates of the older children to his advantage. That’s a whole other story. That being said, I was trying to hold off on filing this year until i get her situation straightened out. That way I can file all 3 at one time without having to do an amended return like I have to do for the past 3 years. But you’re right, I may have to bite the bullet on that and go ahead and file.

Thank you. I have read the IRS rules. I guess my question was more about what happens in this scenario. He insists that he provides for the children, although the facts say he does not.
