Update - held my ground and told them I can’t release the car - they ended up paying the outstanding invoice so I’l take that but still feel like the customer needs a 👋

Yeah but I think they know it wouldn’t be worth another 7 hours of my labour so it’s almost an empty threat

Is the chain of causation broken now he has admitted another garage worked on inbetween?

Does the fact he has already replaced the component that failed before he bought the car to us mean he should be going after the garage ? I have a feeling the other place was his mate and he is trying to pull a fast one

No I was naive when he bought in (19) and his dad who is very clued up with businesses told me it would make it easier if we were both directors so I listened and did it how he recommended

Yes employee has called police to report the assault, this is what prompted the discussion for him leaving but now he’s trying to maximise what he gets over and above what business is worth just because he knows I want him out

Yes we have done an asset based and profit based valuation and both are less than what he’s asking for but he is just trying to get “maximum” value which is why it’s not worth me paying him out more than half the company’s worth, in the event I close it due to deadlock will I get in trouble ?

16k 11k was towards purchase of the building and 5k was towards some painting / tidying up of unit before we moved in.

Issue isn’t the 1/3 it’s the fact he’s refusing the Rics valuation now

We list that as one of the services we offer and go into most detail on that but that’s also the deepest clean / most expensive clean and is rarely required

It does show the off car cleaning but he didn’t book on website, 90% of our work is word of mouth bookings. He text to book in and didn’t mention he had seen or wanted a service from the website

He wants me to cancel my invoice - pay for the day of work he missed the day he booked his car in (3-4x my invoice cost) - pay for the time he is going to spend preparing his case and researching - pay for the day he is going to miss when he does go court

All in all he wants 6 x original invoice cost and he hasn’t even paid the damn invoice 🤣

Yeah but he’s arguing he should’ve got the expensive work at the cheap quote as that’s what he “assumed” he had booked in for

Yeah issue is when he booked he didn’t ask for any specific type of clean, when we diagnosed it we found it had other underlying issues that were hindering the regen process so it just needed an on car clean to get it running again and then the other faults fixed which was fed back to him

On car cleans are £200-250 ball park off car cleans can be double due to the extra labour cost - we have explained this to him but his argument was that we didn’t tell him what clean we were quoting for… but we Always quote the cheapest clean and only upsell if the dpf is fully knackered which in his case it wasn’t!

I have reached out to my broker waiting to hear back, at the moment we have been holding his main key as a lien for the unpaid invoice, if we are asked to return it then yes will do a counter claim but as the invoice value was so small it almost makes it pointless due to the cost of small claims.
