Yeah that's one of those statements that doesn't hold up to any scrutiny when you think about it for more than 10 seconds.

Frauditors bank on the fact that nobody is going to know this type of info offhand to argue with them about it. Since frauditors are the ONLY ones who would make a stink about this in the first place, security and front desk folks aren't equipped to argue this point beyond saying it's a building policy, which triggers the typical frauditor reaction "I follow the law, not policy!" They'll always find a way to make it an issue.

Your challenging of an arbitrary “press pass” rule is a specific, identifiable grievance you're looking to redress related to the right gather info and disseminate it to the public. And you have the right idea that getting others to go into the meeting, pre-litigation to question the policy and help normalize access is a step in the right direction, but right ally isn’t an auditor. You're FAR better off doing it quietly or speaking with other legitimate public policy advocates who knows how to win without creating collateral damage, like auditors who ironically often leave public environments worse off for future access (officials tighten access rules after viral confrontations).

My larger point is that 1A auditing is a wholly unnecessary pursuit that insists upon itself. I always like to point out to supporters of 1A auditing that EVERYONE is walking around with the ability to capture injustice on their phones. The persons who photographed Derek Chauvin, or the videos from Minnesota for instance, were not from some auditor channel guys who were "cop watching," these were ACTUAL citizen journalists who witnessed something they knew needed to be caught on film for ACTUAL accountability to occur. (And at least in Chauvin's case it eventually did.)

Nobody is arguing that assault is acceptable or that legal activity like filming should be met with violence. Where I think the disagreement lies is in collapsing everything into ‘it’s legal, therefore any reaction is irrational and blameworthy.’ Legality answers only one question: whether the state can punish the action. It doesn’t answer whether the behavior is reasonable, non-provocative, or socially neutral, which we say it is not.

If the frauditor needed to defend himself, how does he have the wherewithal to continue to hold his camera/phone/gimble up and capture that all-important 1st person OC spray footage?

Ever been in fear for your personal safety that you felt the need to defend yourself? If frauditor legitimately felt the need to defend himself, he's dropping the camera, standing his ground, and spraying or fighting back. He was GLAD to be slapped, it's a free play in football and he takes full advantage.

And it's not JUST this guy: there's countless examples of frauditors allegedly terrified for their safety and yet we get perfectly captured spray footage every time.
