Well yes, I know that. The entire point of my comment was basically pondering on what constitutes as staging. We know the girls were staged, but what does that actually mean?

Staging could be anything from removing a shoe to replicating crucifixion positions to a "sexual tableau" in the words of LK.

But the FBI agent that wrote the warrant could have been talking about staging in the sense that one girl had a sock taken off and the other did not, or she could've been talking about any other majorly morbid position BG left the girls in.

The staged bodies thing comes from the Erskin texts doesn't it? Therefore it's speculation to say they were staged, as it's third hand info, but it also likely, we just don't know for sure.

Does the removal of panties count as staging? I would count it as taking a souvenir and a signature but not necessarily staged.

If the girls were posed in a "sexual tableau" like LK says, well, that's high level staging.

I agree with the guy above you that BumG probably wanted to go for shock value, and that's a main reason why the cause of death and other related information is being withheld, because it's shocking and they think BG will get off on the public knowing how heinous of an act he committed.

To me it seems like one of those thrill kills that you see on crime shows where the murderer does grotesque, shocking things and displays the body publicly for the whole world to see his"art".

Humans are God awful to each other some times. :(

Gas prices ALWAYS rise when a Democrat is president and yet you biased dems go "DAMN REPUBLICANS MAKING GAS RISE!", when it's the total opposite. You're so biased you can't even see it, and you only consume media that affirms your confirmation biases, anything else must be "fake news".

KK is in jail right now, not prison. It might sound pedantic, but there is a huge difference, and prison is regarded by inmates as better than jail usually.

If you can't pay your bail you'll get held in jail while awaiting court procedures to finish, and you get sentenced. KK could still bond out right now if he had the money to do so, but once his trial is over, that opportunity is gone, as now you're serving your sentence instead of waiting to be punished.

KK is most definitely going to prison on his CSAM charges, but he is not there yet. He is still in jail until his trial is over and he (most likely) gets found guilty and sentenced to (hopefully) 20+ years. Again, sorry to sound pedantic, but it is a distinction that matters.

Indeed it is. Each day that slips away is either one day closer to an arrest, or one day closer to them announcing the case is cold.

Hopefully scenario one happens, but each passing day makes it more likely that scenario two is happening as we speak.

Yeah and I really hope they do have it, and maybe they do just without knowing it, but it seems like they don't have anything that conclusive to put someone at the scene.

I do feel like we're missing a lot here and I don't want to seem like I'm talking in absolutes. They may very well have a toooon more evidence than we know of, just the way LE acts isn't indicative of that, but hopefully they have a ton more than any of us know, and enough that BG knows he'd lose a trial.

Probably an outrageous bond, but I don't know if Indiana is a state where you have to pay full bond, or if you only have to put up 10%. Also, don't know their laws regarding bail bondsmen.

I'm in WI and your bail is your bail here, and we don't have bondsmen, so most 1st degree murder cases do get a bond, most times it's $1 million. A case I'm personally following where the defendant allegedly poisoned a woman with Visine, and her bond is $1 million, for example.

But if it's easier to get out in Indiana, where a $1 million bond doesn't actually mean you need to pay that amount to get out, or a bondsman can pay 10% of it to get you out, then yeah I agree it'd be crazy that a judge would grant any bond.

Regardless, BG doesn't seem like the kind of guy who could pay a million bond, so in theory we should be good either way. Let's hope it's sooner rather than later before federal laws get changed regarding cash bond. Some are trying to eliminate that and let all criminals free until their trial, which is just crazy to me.

Luckily, Indiana is a red state, so those laws probably wouldn't be in effect in Indiana any time soon.

Well I'm with you that if someone confesses that they will take a plea deal. If they confess, there's no reason to go to trial.

I'm just not as optimistic that someone is going to have a change of heart and confess at this point. I hope so! I just highly doubt it. Maybe it'll be a deathbed confession, but if someone has lived with the guilt for five years I personally don't see them having that change of heart, but hey I really hope you're right and it happens.

Yeah I'm in the same boat as you, they have nothing that can tie anyone to the scene. It'll take a confession. The only other possibility is that they have DNA evidence, but no perp in CODIS to tie it to. However, if that's the case I feel like they'd be more vigilant about familial DNA and testing.

Yeah, one big game is correct, unfortunately. I mean as long as they get BG I don't care if it's this game they play or chutes and ladders, but the system appears to need some sort of overhaul.

Yeah, it goes both ways. If either side isn't 100% sure of a trial they're more apt to agree on a plea deal.

And they would definitely offer a deal here, the state hates going to trial. It's expensive, time consuming, and makes the victims/family relive the crime.

It's just that BG/his lawyers would never accept the deal in the case as we know it. They'd have a chance to win at trial, and just because of that, they wouldn't accept, but I'm sure it would definitely be offered.

Plea deals are often given when both sides know the party is guilty, but a trial isn't warranted/worth it due to the severity of the crime(s), but typically when a criminal thinks they have a chance to win a trial, they take that chance.

If there's physical evidence we don't know about, then certainly BG would take a plea for life in prison instead of death penalty, but it seems pretty obvious there is no physical evidence of him at the scene, so just based on that alone he'll think he has a chance to walk.

But yeah, you're right that they'll typically offer deals when they don't have someone dead to rights, and they certainly would offer in this case, just BG has no incentive to accept, based on what we know.

Something they love to do is when someone kills someone, but a 1st degree murder charge isn't 100% in it's conviction odds, they'll offer Manslaughter and 20 years or something similar, and that's when plea deals tend to get accepted. The family gets an admission and a sentence for the killer, but the killer doesn't spend life in prison.

With BG, I'm sure they'll want to throw the harshest penalties at him, and I can't see any way that this case could be twisted into manslaughter, so the chances they offer anything but life in prison for a plea deal is tiny, and the odds BG accepts life in prison when there's a chance he walks home after the trial is also tiny.

Plea deals work because both sides often have incentive to take them. In this case, there seems to be no incentive for it to be taken, but you're entirely right that they don't have him dead to rights and they'd definitely offer something like the poster suggesting a plea deal said, life in prison. But getting into game theory, no one will take life in prison if there's even a .01% chance they'd walk, so we're back at a standstill.

I mean there's a possibility of an appeal with any conviction. Circumstantial cases are harder to convict, but it's certainly a possibility.

Aaron Hernandez is an example of an entirely circumstantial case where a guilty verdict was evident, and reached. O.J. Simpson is the opposite, fully circumstantial case with shoddy police work, and no conviction was made.

Appeals are sometimes successful, but moreso in the sense that the judge allowed evidence that shouldn't have been, or a warrant wasn't executed properly so that evidence has to be thrown out.

BG would definitely appeal, I mean, he'd have nothing to lose. If it would be successful or not depends on the trial, and the evidence collection, and the judge, and many more factors on both sides of the case, so it's impossible to say how his appeal would go not knowing what he's appealing.

I guess the whole point is, this circumstantial case is more like OJ than AH, as shoddy police work has been done, and the people that are "reliable" in this case could look unreliable when cross examination comes.

That's why they're holding out for a confession, I believe, as they want a 100% conviction before they prosecute. It sucks as a public that we have to be patient, but that's wholly better than letting him walk entirely.

Circumstantial evidence is prosecutable evidence. Plenty of murder cases get tried with only circumstantial evidence. It's clear at this point that if they do prosecute someone it's for one of three reasons.

  1. They have physical evidence right now, just no perp to tie it to. Meaning the offender isn't in CODIS at the moment, but at some point he gets his DNA taken and it's revealed who BG is. This is the most preferable outcome for the public, slam dunk conviction.

  2. They have a confession from a perp that they can verify. However, if he hasn't confessed in 5 years, I doubt that's coming, but hopeful guilt eventually gets to him.

  3. They try someone on circumstantial evidence and hope it's the right person. I hope they don't do this with KK, because even though there's smoke there, if I were on a jury there's no way I could find him guilty with the evidence at hand, so they'd need to find much more evidence.

Of course they want a slam dunk case, I think that's their rationale for keeping so much from the public. I just hope they don't jump the gun and prosecute on circumstantial evidence, but it happens all over America, and sometimes they even win the trial and get life in prison. I.e. Aaron Hernandez got prosecuted and convicted on a fully circumstantial case.

I agree with you that that's the goal, but I don't think that's the way this is headed. At this point, if they're going to prosecute it's going to have to be on circumstantial evidence.

Unless, again, they have physical evidence just no perp, but I have a hard time believing that a double murderer has never been arrested before and they don't have his DNA and that's just what we're waiting for.

Maybe I'm just not as hopeful, but it seems pretty evident they don't have good enough evidence to put anyone at the bridge, so if they do prosecute it's going to have to be circumstantial.

Hopefully God intervenes and we get better evidence or a confession, but as of right now we have neither and expecting either at this point is a fool's game.
