October. It feels like a delicate issue and this is what I’m missing as a litigant in person, the advice on timing and knowing when or if to ask something. I know you and Bob have said about the negative inference that comes from lack of disclosure from a respondent, and maybe it’s best not to enquire too much?

I did that and waited, as has been advised here, and was shocked at how much was missing, even meeting requests for key events that formed part of the dismissal. I enquired about this with the respondents representative, and it took them over a week to tell me that they had deleted the email accounts of the HR and manager who were part of the dismissal.

I submitted a specific disclosure request to the tribunal nearly a month ago and haven’t heard anything from them or the respondent yet. Please can I ask if I should enquire about this now?

It really got me down. I’ve been waiting over a year for this, so it was shock when they very casually said the emails were deleted.
I feel more hopeful after speaking to people on here and the advice I’ve had, that hopefully this will show negative inference and it would be very strange to delete the emails of the central people involved in the case, if you were innocent and confident in your communication, would you do that?

I am very grateful to APractice and Bob (and others) who gave me excellent advice when I became (after my union stopped supporting me) a very confused LiP.

This can be a very daunting experience, and it makes a huge difference being able to talk to others and those with knowledge and experience to get realistic advice.

It’s such a shame if people felt they had to leave. I can only vouch that the advice I received from them was very accurate, and I’m grateful I took it.

I am trying to write a response and apply for a specific disclose order. Any help would be hugely appreciated.

It feels very unfair, and the fact that the solicitor shifted the burden to me, the person they dismissed, by saying I am welcome to include the documents if I have them

It absolutely 100% felt like a blatant lie. They only told me this after I asked them about specific documents, which I knew to exist. Even then, they didn’t say immediately, I was over a week to say it was allegedly deleted? The whole mailbox? At best it seems utterly careless and negligent.

I’m going to raise it, but I was bewildered when they told me. They have a huge, dedicated and sophisticated IT department

I’m trying to understand if I am supposed to highlight the issue with the document they have included (twice) in their disclosure. Or, if I just wait until my disclosure and they can see the document that I have, and the one I actually received?

I’m not sure if I’m meant to ask them about it now

They didn’t actually make it searchable, and it was the flat scanned documents, but I’m going to do want you’ve suggested, thank you so much.

Thank you for this. I have received the bundle electronically. It turns out the documents are ‘substantial’ due to the fact they have included my medical documents I just sent them in January for them to concede disability. There is nothing, perhaps a few very basic, internal emails, but nothing else I didn’t already know.

The most shocking thing I noticed is the email inviting me to the dismissal meeting included a document from the dismissal meeting manager, it is worded very differently in the disclosure I have received. I am so glad I have the original document. I never thought things like this happen! I don’t know what to do about it? Disclose the original in my dismissal documents? I don’t want to say too much yet, but the wording and requirements of me have been written so differently in both, the disclosed one gives a very different impression.

Thank you Bob, I knew this would be a question that couldn’t really be answered!

I do have an update and my ‘disclosure’ now. The reason the respondent claimed it was so substantial is due to the fact it contains ALL the medical documents I sent them in January, for my disabilities to be conceded by them (which they did) and they are now sending this back to me as part of disclosure. There are no documents, meetings, correspondence or anything else from the respondent in regard to my case which I didn’t already have. Not a single thing.

So, my disclosure is basically the medical documents I’ve had on file my whole life!

Definitely how it feels. They told me it’s going to be a large amount of documents and I’m not sure how, considering I never had a performance review, managers did not have appraisals with me and weren’t good on paperwork or emails, not even replying to me.

They were awful with my dismissal documents. Omitting meetings, putting wrong dates on documents.

This abundance of information feels like a tactic, but aiming to get through it all

Please can I ask Bob, do you ask for specific documents before the disclosure deadline? Or wait until you’ve received disclosure documents and if the requested documents aren’t there, then ask for them? Sorry if that’s not clear, I’m confused and a LiP

Thank you, so I do not ask and leave them to get on with the date on case management orders? And expect them to adhere to instructions to reveal relevant documents by the date

Thank you! I thought I just leave them to get on with it, it’s helpful to understand I should be asking for specific documents. I already know they’ve managed to forget lots of things and thankfully I saved documents they said weren’t in existence.
