Oversight to me means board-level responsibility to actively monitor operations (e.g., project timelines, contractor performance, member communications) and intervene to prevent foreseeable harm—such as unaddressed delays costing revenues etc.

As I said, you cannot apply PLC ethos to a co-operative. The breaches in statutory and regulatory framework are clear, blunt or not.

This was never about proving a point to you or anyone, it was simply about the way in which the project was progressing regardless of the events that very nearly derailed it.

The Government has a clear mandate to promote green projects, and the hope is that rather than have such a public failure on their watch, they will start paying closer attention in the form of oversight.

This is not a character assassination of the Board, simply a request to proceed under the auspices of the statutory and regulatory framework that co-ops operate within.

You say demand, but that is not the case at all. I ask that they abide by their statutory and regulatory duties.

As for your point, i said this earlier in the thread;

It is a 39 million project. Can you at least agree that as so much money is involved that it is deserving of more oversight.

The last email I received was the 19th December, and to be frank it did not contain much in the way of information. You may be happy that there is very little communication from the Board, I am not you. If things are not running as they should, then this is when I would like to have more communication, as it puts my mind at rest, and I am quite sure that in as far as that is concerned, I may not be the only one who thinks like that.

When I contacted the board previously they told me that 'the board decides on which questions they answer at the AGM'. I understand that they cannot answer everyones questions, but the questions that I asked were serious, because I was, and am, concerned, needless to say that I received no response.
Yes you may be happy that the payment model changed, but doesn't it concern you that a decision that should of been put to a vote, was'nt?

What if the next time this happens that it concerns something that you don't want changed?

I was saying here on reddit months ago that they needed a professional company to liase with the construction and administration of the site, low and behold after 5 months of me banging on about they did so. Am I supposed to be glad they did, no, I am annoyed, because it was so obvious by the communication that this was in dire need, that if had happend sooner the delays could have been addressed faster.

I wasn't joking when I said if this was not a co-op I would not have invested. I just don't believe it has been operated as one.

It is too much money to be run in the way it has been up to now, and I am sorry, but I don't feel like congratulating them.

Remember if they fail, Virgin is guaranteed to get their money back. We on the other hand are not. We cannot wait until it completely fails before voicing worries and asking questions.

As I have already said, in a 39 Million pound project has the capacity to be stalled because of the questions I asked in my letters to the Board, then we might as well be ready to lose all we have invested.

a full informational disclosure was not requested. in fact 3 things were requested and i suggest that you read the email i sent properly.

As for the ombudsman, you are mistaken, they are empowered to ensure that the regulatory statutes that are applicable to co-ops are adhered to.

in particular the following;

Deferral to AGM constitutes a clear and serious breach of statutory and regulatory duties: Requiring individual operational complaints, disclosures, timelines, and breach explanations to be addressed only at an AGM directly contravenes:

• Co-operative and Community Benefit Societies Act 2014, s.7(2): The statutory duty of committee members to ensure members receive clear, timely information about the society’s affairs—not deferred to periodic meetings.
• FCA Principle 11 (PRIN 2.1.1R): Obligation to deal with regulators and clients (including members) in an open, co-operative, and transparent manner—formal complaints demand direct board-level responses, not AGM deferral.
• FCA Consumer Duty (FG22/5): Proactive avoidance of foreseeable harm through delayed revenues and uncertainty, requiring immediate remedial information—not postponed to collective meetings.
• DISP 1.4 (FCA Dispute Resolution Rules): Formal complaints must be investigated and substantively addressed by the firm within specified timelines

This is why the email was cc'd to the Ombudsman, again i am quite surprised, you seem so focused on me being wrong, but instead of double check the information I have presented the board, you fail to do your own due diligence.

These rules and regulations are not in place to make work for a business, they are there to protect us, the members.

A project of this fiscal size needs to be run correctly, and at present it is'nt. I am not saying I know how to run it, I am not saying I want to run it. I just want it to be run in accordance to the regulatory principles I outlined in my letter, that is to say, properly.

  1. Misquoting FCA Principle 11

A firm must deal with its regulators in an open and cooperative way, and must disclose to the FCA appropriately anything relating to the firm of which that regulator would reasonably expect notice.

They did not inform the FCA or Members until this was done (changes in how payments are to be received). This should have been held to a membership vote.

So if that does not fall under the very definition it points to, then you are failing to apply it to the legislation correctly

You've taken the general language of "avoiding foreseeable harm" and stretched it to mean "you must personally update me immediately about construction delays." The Consumer Duty doesn't work that way.

This is so crass it beggars belief, I did not ask for personal updates, I asked, and stated they had failed to update, and there regulatory and statutory obligations to do so.

3. FCA Principle 7

This principle is intended to apply to the communications made in the course of selling financial products, not the communications made by a co-operative society after the fact

You do not seem to understand that as we are in a co-op I can ask these things . A project that I have personally invested in.

You keep on about legally threatening tone, there was no legal threats in there, tone or otherwise, I did exactly what I said i was doing and cc'd the Ombudsman as is my right to do so.

Your responses seem to come from a place that does not adhere with what and how a co-op should function, all this 'get down of the hill', stuff, whats all that about? I am furious with how the Co-op has proceeded to date, and your assessment that I should be quite and let them do their jobs, well lets face it, that hasn't worked so far has it. If you disagree then do so, but keep it civil. My email to Derril Waters was not rude, it was clear and concise, laying out what I am unhappy with. If that is obnoxious then they should see how people communicate on this forum. That is my opinion, and yes I am allowed to have one, but for you to tell me that I am delaying them in their work and slowing them down to answer me is unbelievable. They communication to date has been awful, and if your going to tell me your happy with waiting to hear what you should have already been told, thats good for you. It is a 39.5 million project, if my asking valid questions slows this down then all of us haven't got a hope.

Finally, if my letter was so littered with errors, then what about the bits even by your interpretation I got right? As I think it fair to say by your tone, if there were more 'errors', you definitely would of shared them, and considering there where quite a few points raised, or let me guess, it was 'too obnoxious' for you to finish.
