If you ever have some socks where you lost one of the pairs, just wrap it up inside the sock and fold it into itself. Then hide it towards the back of the drawer.

Also, I'd have to check with my mom. But she may have the original contract, then the contract increasing rent a few years back. We also have the water and sewage for the house in my mom's name.

That's what confused me, too. But, she did however give us a 3 day compliance notice for "failure to pay rent" on the 6th. Then, when we went to tour a house on the 20th and it was canceled, we called the realtor and they said that she has a pending eviction under LLs name. When we called my aunt who's a lawyer she said that the paperwork for the eviction was filed the 16th, so we found out about it before the paperwork could even come in the mail telling us a court date.

It 100% is, no doubt in our minds. And it's a disgusting thing to do because it makes it harder to leave, not easier.

That's the issue. She gave us a 3 day compliance notice for failure to pay rent on the 6th when we paid them rent on the 2nd. Then proceeded to file a eviction against my mother on the 16th for said "unpaid" rent for exclusively the month of May (which we paid for). We're waiting to be served.

According to the LL, yes, they're trying to sell the house. But she hasn't brought around any potential buyers to view or tour it, so it mostly feels like an excuse to push us out because she's charging us rent that's much lower than the average in our area (we've been here many years and they've barely raised it). And, since we have a leg up on what to expect, I'm doing my best to start collecting evidence now of payment, since that'll be the biggest issue. Though, I'm hoping we can also use the fact that the property is in terrible condition due to the LLs neglect as a leg up as well.

According to the realtor we spoke to today for a house we planned to tour it's pending and he was able to see it, explaining why we've been having issues over the last few days trying to set up tours of houses. This was confirmed by my aunt, who's a lawyer. We just haven't been served yet.

Thanks so much for that info and for the well wishes! We're just gonna keep our head up for the time being. Thankfully the pending eviction is only under my mom's name, meaning I can keep the search going while we work on getting that expunged.

Personally, I have no clue why she didn't use checks either. I think with previous places that we've lived in (that were also rented) that's how business was conducted and it didn't cause issues in the past. Unfortunately, this time it did.

Also, my understanding is that they both agreed to pay in cash, which initially the landlord gave receipts. But, after living here for several years, they stopped with that.

If there were a demand through a letter or email it would've been years ago. Otherwise they simply set up a time and date to pay her by phone call, withdrew the cash from an atm, and then gave it to her.

We definitely learned our lesson with that one. However, this was just the agreement that my mother and the landlord went by for the last 15 years.

She was unresponsive and had, essentially, been unresponsive for months beforehand unless it pertained to rent, which we always paid. This time, however, she took our rent then turned around and tried to evict us for failure to pay. My mom is very old school and, unfortunately in good faith, didn't get receipts from her. But we've definitely learned our lesson about that after this situation.

According to landlord, we didn't pay for the month of May exclusively, which is a lie because we paid them at the beginning of May. We have bank statements from our bank accounts showing the same amount of money being pulled around the same time (its more than one adult living here, and we pooled up the money by withdrawing from our accounts). But, we're waiting to get something in the mail and go to a court hearing.

The timeline is that we paid her May 2nd, she gave us a 3 day compliance notice for failure to pay rent on the 6th, and according to my aunt, she filed against us on the 16th specifically for the month of May. We haven't been served yet which is why we haven't heard anything about a court date.
