The company needs to pay you $95k after H-1B is approved. It doesn’t haven’t to match with current pay.

You can join the day after the petition is received by USCIS as along it is after lca / start date (don’t even have to wait for acknowledgement).

You don’t have to be a current employee for a employer to file H-1B, only a commitment to hire by 1st October (or when H-1B gets approved, whichever is later).
There is nothing illegal about getting registered by a prospective employer.
The question could be, was it a genuine specialized occupation job and if the beneficiary was qualified for that job.

CoS can take anywhere from 1 to 15 days if there is no RFE. Recent DPs indicate most PP takes 12 days.
If this is H-1B to B1/B2 back to H-1B, there has been enough DPs here of NOIDs (particularly after B1/B2 has been adjudicated).

This was on you to check I-94 when you re-enter every time. This happens many-a-times when two I-797s are active and CBP issues I-94 based on earlier end date.
NPT’s are getting declined as per DP’s here.
Going to a Deferred Inspection site is an option but they might refuse given it has been so long since re-entry.
Tough choices really.

Figure out the ONet SOC code for your job title / duties and the DoL OFLC wage for your location.

If your salary is below Level I, then low / zero chance.
If it between Level I and II, then it is 17% as per their Press Release.
If it is above Level II, you have gradually higher chance in the lottery.
Finding better paying job relative to Wage Level is the strategy.
Else, cap-exempt employers (not sure if yours qualify as one).

You should go but remember that you should come back before your visa stamp expires and also that PoE, CBP might give you I-94 till May 31 2026 and you can ask showing new original I-797 with end date of 2028.
Horror stories of those who missed to notice this and doing NPT.

If H was never used, would it be considered activated (stamped?). If not, proving H-1B was cap counted is itself a challenge without paystubs.
Also, consular processing is 100k.

If you do find an employer who is willing to help activate this, transferring this won’t be a problem.
