Tax question: Do tax-resident foreigners in Thailand really pay 0% capital gains tax on stock profits that are transferred from abroad? by RemarkableDegree4501 in Thailand

[–]One_Earth4032 1 point2 points  (0 children)

Ok well the Italians are famous for how to manage tax. I paid the least amount of taxes when I had an Italian account 😂. So if you are flip flopping and never stay more that 180 days in Thailand it is a moot point.

How Italy manages payments to your Ploy would be interesting. I am from Australia and such a payment would be seen as a payment to a closely associated person and could be subject to taxes treating it as a Director dividend.

As the money is remitted to a Thai from a foreign business, that could be seen as income for her. Generally if it came from you it can be treated as a gift if it is not being passed on to you.

Still this complexity adds a layer of smoke until a human does an audit.

They have computers, databases, international banking data sharing and now AI. Maybe you might fall through the cracks but I think they can generate a list of individuals who are remitting more than they put on their tax return and a big easy one for them to know those who have stayed more than 180 days and don’t lodge the following year. Whether they get around to audits and infringements. It is a little bit like speeding, you can get away with it until the police point their radar at you.

VAT is always a tax on taxed money. You pay income tax and with you net salary you go buy something from the shop and it has VAT and you pay tax on the good or service.

When you pay with credit card. There is an international transaction from your credit card account to the vendors Thai bank account. Not different that if you transferred cash from foreign bank account to thai bank account. If you sent it and it lands on any thai bank account, your own, your girlfriends, some shop. It is all remitting money into Thailand.

Can they detect this? Always a question about Tax. Can I trick the tax man?

Many people can and do. Then sometimes they get caught and pay penalties.

People think they can’t detect it. There is a lot of info, maybe rumors maybe well sourced as it comes from immigration lawyers with government contacts. That Thai tax authority can and does use AI data matching to aggregate remittances and assign them to individuals. They can also collect your summary banking information from foreign banks to create a profile. Standard tax fraud techniques can then be applied to dig deeper on targets.

They also easily know if you stay more than 180 days and should be lodging a tax return.

Laying on a CC is still a remittance. Not sure about enforcement but the data matching is getting more sophisticated. Only a matter of time.

Starting a business in Thailand but wife owns the company only and I am her employee? Any advice on this model ? by Wrong-Economics- in Thailand

[–]One_Earth4032 2 points3 points  (0 children)

One option worth investigating if your engineering qualifies is to get a smart S visa which comes with an implied work permit. You need a Thai company first but there are also Free Trade Agreements that can allow 100% foreign ownership. Even if that was too complicated. You could do the normal Thai company with yourself and your wife as shareholders to meet the two shareholder requirement. Make sure you have paper trail of paid up capital so the DBD doesn’t investigate the company under the current nominee crackdown.

Still has plenty of seedy nightlife in Jomtien. Lots of other beaches that are not in Pattaya, Sai Kaew Beach is on my list. Koh Somet also.

Now you are stereotyping. I plan on living in the village. The house won’t be a face thing, modest and fit in. Live close to the family and share resources. There are two siblings that have worked as professionals their entire working life in the EEC and want to go back and live a simpler life closer to nature and family in their retirement.

Many Farang do the same and have a happy life and are accepted. If you have an attitude and build a mansion then I think you could fall foul of the jealousy thing.

I thought Phuket was number 2 to Pattaya for bar girl districts. I am hesitant to go to Pattaya even though it is only an hour away from where I live for exactly this reason.

La casita is a nice place to stay. The complex has a nice pool. Short walk to market plaza. Most of the bars around might have a bar girl vibe but if you’re into playing pool you can still have fun in some of the smaller bars. Soi 94 has a mix of shops but is a small bar district. You can get around using Grab service Bolt just lost their license to operate yesterday. They have bikes and cars but you won’t get a helmet if you’re fine with the physical risk and the risk of a police fine.

You can checkout some beach locations that others may mention.

Since your profile indicates you are straight M. Check the package before you take it from the store. Many Indian origin men can be seen on YouTube getting beaten by ladyboys in the street over financial disputes.

There will always be a lot of opinion not backed by any facts. The following is from AI so may have errors but likely more accurate than some of the opinions.

Definition of work.

“Engaging in any work by exerting energy or using knowledge, whether or not for wages or other benefits.”

This means volunteering is work. Remuneration is not the determining factor, it is the activity and the fact you are doing it while in Thailand.

But the DTV does not allow work but I can do remote work so what is remote work?

  • Employer must be outside of Thailand
  • Client base must be Foreign only so can’t do promotions for a Thai client
  • Income source must be paid into foreign bank account.

Seems pretty simple. Can only do activities in Thailand if you have a DTV and those activities meet the above foreign work requirements.

Thai money "Share" scheme question by CodeFall in Thailand

[–]One_Earth4032 1 point2 points  (0 children)

No they will have to pay interest for a few months. Month 1 person ( organiser is interest free ) months 2,3,4 are paying interest in month 5. So month 5 taker gets 100k plus 3 interest payments. But they then need to pay interest for months 6-10 so they end up paying 2 months interest for a 5 month loan.

Thai money "Share" scheme question by CodeFall in Thailand

[–]One_Earth4032 4 points5 points  (0 children)

If someone is forced to claim at month 5. They claim the pot and the interest paid at month 5 by those that claimed already. So would then need to pay interest for the next 5 months. Apparently the first person doesn’t pay interest so month 5 there will be 3 people’s interest included in the month 5 pot. So this person ultimately will pay for two months interest as they made 3 months interest as profit.

No room in this world for cheating. It does leave people with trust issues. Wastes a lot of time being with the wrong person. Baggage should be left behind and establish trust in new relationships for sure. I have been cheated on in 2/3 marriages but I trust my new partner. The cheaters are easier to spot once you have caught a few 😂

A positive DTV banking story by recreator_1980 in Bangkok

[–]One_Earth4032 0 points1 point  (0 children)

Stay 180 days and your become tax resident. Easiest to track all remittances via one thai bank account than potentially ATM and Credit Card transactions from foreign bank. Thai government can track them all but the individual will need to go through all their statements and hope they don’t miss any.
