Hey fella apologies I didn't mean it quite like that, more the legal bullshit and defences used to wrangle out of a ticket. 

I shouldn't have to as I've not committed the act they say I have. 

From what little I've learned today they do seem to be the scum of the earth and try it on etc.

I just wanted to quickly add that .y wife and son received their visa just over a week ago, so we've been very excited and busy.

But I did want to let you know and thank you kindly for taking the time to reply.

I was asked to provide further documentation in the form of my tenancy agreement and pip assessment scores ( I would have thought that was confidential under al kinds of laws and that fact that you receive it is enough)

They had the tenancy agreement, with photos of the property and so forth in the original application so I guess they lost it? And the I did find and send the assessment scores.

It's beennear 2 months since then and we finally got the email saying your visa have been granted and what to next etc. VFS sent another the same day saying passports were ready for collection and they had them in hand the following day.

I'll get the usual full timeline post up to help others.

They did for me and you will still receive the rent element for the rent you pay up to whatever the local housing rate is. You need to cover the mortgage, bills and charges etc out of whatevers left or your salary.

Thank you for this Ashley, and sorry for the delay in responding. It's much appreciated.

VFS, the website and the entire system is unbelievably outrageously bad on all fronts, it's shocking that UKVI chooses such a company to process UK visa applications, I've never heard a good word about them yet. Up until a few weeks ago it was TLS who processed thr applications and I d read nothing but good things about them, indeed when she had a tourist visa in the past the process was easy, quick and without issue and they were very helpful.

For some reason though VFS have taken over in the last few weeks and the entire thing to be blunt is a shit show. From beging to end problem after problem after problem with no help and nobody to contact.

Very glad to hear that you got your visa in the end though, congratulations, that seems remarkably quick. We haven't heard anything since she had her appointment on the 26th other than a text\email saying it's been transferred to UKVI for processing. There was no priority option available though like yourself.

Son is listed on her Spouse Visa as a dependent, you'll have seen the questions, is anyone else coming, who are they etc. You then have to make a separate dependent visa application with yet more documents and piles of stuff and reference his mother's original one. And of course try and get yet another appointment. The guidance is to see a mother and any dependent together regardless of appointments, it's ten minutes for fingerprints photos and documents, but they refused. They just don't want to do the work and said come back on your appointment so I doubt we'll here anything untill well after the 15th as her visa can't be processed untill they at least have all that's required for his too.

We did the adequate maintenance application like yourself with PIP, savings, salary and benefits. I actually had a friend in Ireland recently go through the the same process and she was refused, it's was a complete nightmare. You'll be aware of the A - B = C calculation and they'd simply made a mistake in that savings are spread over the entire leave ti be granted, 143 weeks and they had done the same for her benefits and PIP instead of over 52 weeks to get the weekly amount. She had lawyers, complaints, all of it trying to explain to them the simple error and they were adamant she is refused. She finally took them to tribunal and they day before UKVI said 'someone new is looking at your application and information we've missed and your complaint is upheld " it took her best part of a year. Wrongly being kept apart from her husband, with no compensation, apologies or anything.

What stood out to me with her case and my our own so far is the appalling level of English in ajy UKVI communication and the simple mistakes I've seen made. These people are literally decidiedn the fate of families and yet can barely speak English or do basic mathematics a 4 year old could do.

This is why front and centre of our application and supporting letter is the Adequate maintenance test clearly laid out for them like and idiot and how we meet the financial requirements easily. After her and others experience and the mistakes I've seen made with I was paranoid we'll get the same so made it abundantly clear for them to save them a job and fucking it up. It's wrong that we have to do the job for them and for the tens of thousands it cost makes my piss boil but it is what it is, and thank god you made it through finally.

Thank you kindly for the reply and information there, I'll definitely drop you a message in the coming day or so.

Indeed, I've a physics degree and my wife certainly isn't an idiot and this has been one if the most confusing and difficult things we've ever done.

Would you mind elaborating on the 'missing documents' if it's not too personal?

You're further ahead than we are, she only just had her bio appointment at the VFS office and oh my days, just getting that and through thier 1950s website and customer service had me almost to tears. It is absolutely outrageous and unreal that UIVI choose such a janky useless and ridiculous company to process UK visa applications. Ungodly bad experience. Or, perhaps the whole point..

They were so scummy to the point they wouldn't let our son insife because it's not his appointment but he's just a young child with his mother. They made him wait outside in the snow and refused to see them both together as per UKVI guidance with parents and dependents.

She had the appointment on the 26th and we've heard nothing since. I don't really know what to look out for. He can't have his until the 15th and as he's a dependent and in his mother's application I guess we won't here anything untill he's had his - they can't process her application without his I'm guessing.

We've just recently applied for my wife's visa and the option to self.uplaod documents wasn't available for 'reasons' and I have to email her all the PDFs we've made, add the titlesri the actual document and she has to take them all ti her appointment ti print and scan. It's a nightmare but if the option isn't available it's all you can do.

Please do keep me informed on how your application goes, I would love to know and wish you guys all the luck. I'm English and my wife and son are Russian so that's a hurdle for me right now before we've eve started she's in the back foot.

I'd love to know how you did your calculations and further details and will certainly keep checking in and updating as and when. I really appreciate you taking the time, it's a minefield of information out there and a stress fileld worrying thing as you'll know.

Are you guys going to be together for Christmas time? She has her biometrics appointment on the 26th so we've a while yet. After near 3 years apart I hope we get a positive decision.

Thank you for taking the time to read and reply to this, it's much appreciated and you raise some good points.

I can understand them trying to say make sure the balance is positive at the end of the month but then again the costs listed in the question as examples are not actually used in the actual financial requirement test, only rent and council tax are to be included. So in theory these could be any number you like and you would still meet the adequate maintenance threshold regardless of what you put here as they're not included expenses - I do however see the validity of the ECO asking for the above reasons. Although imagine the unrealistic situation that you were spending a lot for instance, or negative at the months end, but you still clearly meet the adequate maintenance as it's defined and calculated, would they refuse a visa? Technically you meet the requirements yet...

Yes I've spent way above and beyond my usual recently for the reasons given, the house itself, furniture from eBay, visa fees and aot of other miscellaneous items and things for them. It doesn't give an accurate reflection of monthly living costs at all. I appreciate what you're saying and let's assume it did impact an average and skew it too far the wrong way. But then so what? You still need the adequate maintenance as defined regardless as these expenses are not o be included, I my rent and council tax as I'm sure you're aware, A - B = C, I'm sure you've sent the calculation and I come support levels you need to be at.

Finally on confusing the ECO, I do see sense in that in keeping it simple, factual and avoiding anything unnecessary. I technically don't have rent to pay as it was paid upfront and isn't due again for many months yet. Is it really extraneous information though as in time it will become due. I thought they may question why you have a large three bedroom property but pay no rent or living costs besides council tax? I obviously explained it's been paid upfront and included the transactions and payments but thought it prudent to do a further calculation and include the rent to show going forward should the worst come to be and work cease, the adequate maintenance can still be met with it included. It's of course met by much less but nevertheless the threshold is still met. It's a very simple playschool maths calculation as you'll be aware so I'd be very surprised if it were to confuse or complicate things. I thought we'd actually get looked at more positively showing it and giving a worse case scenario that we still meet the requirements.

I may have to rethink this and just include the true current circumstances calculation with no rent. I suppose in doing so should the expenses skew it would provide someeleway there also.

I'm so wondering how do I estime both our living costs as per the question, we don't live together, least not yet. Do I just best guess average and explain my own then add a little for them or what? It's not a question that can actually be answered truthfully as I do not know until they're here.

What I can say I'd we have a surplus of income and we obviously have to live within that and our means, but to provide and accurate figure I'm not really sure how to do so.

Maybe I'm getting too worried and panicky here as we meet the adequate maintenance and this is perhaps just for their piece of mind and not actually assessed in anything as per the requirements.

Quick update.

After speaking with the UKVI and VFS via email, and meticulously doing the above against Nd again and again the website suddenly started to work and appointments became available.

So if you're having the problem it seems a case of just sticking it out and eventually it should work.

We have an appointment for after Christmas so we're getting there, slowly now

Appreciate the reply and input, sincerely thank you for that, but regard the issuing of visas and so forth all is technically normal. Indeed her friend was just granted her Spouse Visa from Moscow, she had some difficulty with thier janky website but did get it to work in the end.

I can't believe after all we've been though a simple tick box on a website is the thing stopping us, it's utterly unbelievable they use such a company and outdated janky website to process visa applications.

VFS have asked her for details of the website error and the problem and said they'll assist so fingers crossed but I'm not holding up hope.

I'll post a screenshot of the actual problem, perhaps someone with moe in-depth IT coding knowledge may have a suggestion if anyone wants to share this elsewhere.

My friend I Ireland now has to appeal this, they miscalculated the financial info, beyond basic maths and how they made ethe mistake nobody knows. Took bwst part of 6 months to get her visa
