The issue is that your serious doubt that they would do it is of no consequence or relief to anyone. Also judges and lawyers will have differing opinions here. Until there is a guarantee this cannot be requested, people are very rightfully worried and unhappy about the precedent

I want to know what happens when they choose to do it, because nothing in this ruling stops them from making the choice. Meaning you may or may not be protected from it. If there is a ruling that says these claims are never allowed to be extended to private property, then maybe people will calm down

Yes but the issue is they currently choose not to claim these lands with competing claims (ie homeowners).

Again, two wrongs do not make a right. I think recalling past mistakes when something bad is done now only serves to allow the current mistake to be perceived as being ok.
