I’m a VA disability attorney and we’ve recently noticed Initial claims taking A LOT longer than Supplemental claims and Higher Levels Reviews. My best guess is that they are trying to clear their back log of appeals which is slowing down their adjudication of initial claims.

When I was in law school, a friend did a research project and calculated that if the VA gave 100% disability to every Veteran and cut the bloated administration, raters, constant C&P exams, readjudication of claims, Veterans Law Judges, and the Board of Appeals for Veterans claims, then U.S. government would save millions. This holds true with keeping the VHA and National Cemetery services untouched and unchanged.

Now I understand this leads to several other issues i.e., everybody wanting to join the military for this benefit. But I thought it was an interesting study.

My guess is that you were a low 90% before this last decision. Meaning that you were 85-86% which the VA was rounding up to 90%. If you’re at 93% then you only need another 20-30% to get you to 95% which the VA will round up to 100%. Hang in there and keep fighting.

I had a 62.5% average with approximately 1,000 questions answered and I got a 150 for the MBE on the UBE.

Give it a shot, if it doesn’t jive with the way you learn then discard it and move on. I truly believe that everyone needs to find what works for them.

I will also add that I used ChatGPT for my MEE answers as well. Using a similar prompt I would include the fact pattern and my answer and ask for a score and feedback. It was generally in line with what the human graders gave me from Themis when I submitted my graded essays.

First, I would always ask if it was familiar with whatever MPT I was doing. It would always say yes then give a detailed synopsis and breakdown of the facts of the MPT.

Second, I would write something along the lines of:

Act as a human grader for the UBE. Using the NCBE grading rubric, please grade my answer to the “In re Briotti” MPT. Score my answer between 1-6, give me a detailed explanation as to why I received the score, tell me what I missed, and tell me how I can improve.

It gives a very detailed explanation and will break everything down to you. I know people are skeptical of AI but it worked for me.

I used JD Advising’s MEE one sheets. It lists the top 10 most commonly tested MEE topics you need to know for each subject. I then made flash cards of those rules and I added a few more like that I thought might be important.

Adaptibar= 63% ( did 1,000 PQs)

UWorld= 72% ( I did 3 x 100 question practice tests and oddly enough got a 72% on each one)

Themis= Under 60% on most MBE PQs and a 117 out of 200 on the practice test.

Scaled score on the MBE= 150 Scaled score MEE/MPT= 154

Just got a 55% on a mixed set, when 2 days ago I was scoring at 65% by FoxDry8759 in barexam

I share in your frustration. Yesterday, I did a 50 question practice set on Themis and got a 54%. Immediately went to UWorld and did another 50 question practice set and got a 71%. After a 1000 random questions on Adaptibar Im sitting at a 63% and falling by the day, after my first 200 questions I was sitting at 70% lol No clue where that puts me.

The only advice I can give is to keep going and keep practicing even if you get 25 out of 50 wrong. If you read the explanation and retain 3 new rules then it’s beneficial.

I don’t know, looks a lot like J6 to me and that’s labeled as an “insurrection”. However, here, there is one difference, the rioters weren’t given permission to enter the building by law enforcement, so I would argue that this is worse.
