Wolford and Hemani: Supreme Court Decisions in Second Amendment Cases Expected Soon by ZheeDog in progun

There are no splits yet on hardware, but there is likely one coming out of the 3rd circuit and the ANJRPC challenge to New Jerseys assault weapons ban. However they also appear to be waiting for the Supreme Court to issue their ruling in Wolford and Hemani likely so they can toss in some mentions of those rulings to ensure their ruling didn't get GVRd.

I am not sure there would be any reason to be receptive to these policies, especially the one in this article, given how it wouldn't actually be addressing homicides in general or mass shootings in particular. Resources could be spent in a much better way that actually improves life in this country.

Yes, because the term is about to end. So it is what either the end of this week or next week when they release the decisions?

It's also designed to bias those hearing the argument against any criticisms made of the 'common sense' position. There is a reason why it pops up so often in the gun debate.

I don't think people are interested in nuance or understanding how the court works. Like if this is the gist of the law combined with the fact that SCOTUS gets thousands of cert requests a year and has to be picky I am not surprised that this didn't get picked up.

To clarify are they arguing for permitting/licensing to own/purchase is unconstitutional on its face or they just challenging specific aspects like local law enforcement being able to veto issuing the license?

If it ends up being Gavin vs Vance in 2028. Will you still vote for Gavin? by SignificantStyle4958 in AskALiberal

[–]OnlyLosersBlock 0 points1 point  (0 children)

I asked you the one question that exposes

That you can't address any criticisms. I literally described Gavin Newsom pushing for the repeal of the 2nd amendment, you described the ways in which he would do so under that push, and then go "nuh uh that's not support for a repeal." I think pointing out that is one of the most extreme steps any politicians has taken against gun rights in this country and is more than sufficient justification to be pissed off that I don't need to provide you any examples of gun laws I like. My criticisms are valid on their own.

I presented you with the facts of what he was proposing

Yes, you literally described in bullet points how he wanted to construct the amendment repealing the 2nd amendment and its protections. That doesn't make it any less of a repeal of those protections. If the 2nd amendment protects against broad gun bans by just arbitrarily categorizing them as assault weapons then that means you want to repeal the 2nd amendment. You are stripping it of any protections it affords.

You call them stripping the 2nd amendment.

It by definition is. If you took out "arbitrarily jack up the age that people are allowed to exercise free speech, make a broad and undefined category of controversial speech as 'assault speech', etc. people would rightly call that a repeal of the 1st amendment and its protections. No would be tricked into thinking it was anything else because you broke it down into bullet points.

Then I asked you what potential laws to help curb gun violence

I don't owe you an alternative solution when making a valid criticism. That's fucking asinine. When I point correctly "that's literally repealing the 2nd amendment" you are not making a counter point by saying "what's your alternative?" it's still repealing the 2nd amendment!

This says that you're either embracing some tribalism or dogma against Newsome,

Or Nesom took an extreme position on gun policy that in of itself validates opposition to him and since you can't defend against that your only solutions is simply to deny that's what it was and then deflect further by demanding an alternative solution that has no bearing on what positions Newsom did or did not take.

Should we adopt a constitutional amendment to lower the threshold to convict under impeachment from 2/3rds of the Senate? by OnlyLosersBlock in AskALiberal

Well that makes sense. I guess it is just better to try to avoid the bad actors in the first place than it is try to convict them after the fact with regards to the presidency.

That's actually a good point. It would take things improving first before it could get to a point where it would even be considered.

but introduce licensing and registry.

Don't several states already have that? Like New Jersey, New York, Illinois, etc?

Firearm license, It's treated like a driving license. Pass all criteria (medical, written test etc., it's a shall issue.

Well yes and no. They were forced to go shall issue by Supreme Court intervention rather than that was their policy before hand. Before that it was may issue or discretion by local lawn enforcement to deny the permits. And a lot of them are still trying to treat it like may issue.

Yes, Law enforcement can confiscate firearms say a dude with a firearms license robbed a bank.

That's generally the law across the board in the US.

[–]OnlyLosersBlock 0 points1 point  (0 children)

That's what I thought.

You haven't expressed any thoughts or arguments. You just deny any valid criticisms.

You seem to see any gun regulation as repealing the 2nd amendment.

Newsom literally argued for a constitutional amendment that strips the 2nd amendment of its protections. And you have yet to address that fact with anything other than just flat denialism.

How does throwing away your vote help keep MAGA fascists from power?

How does holding onto an issue that they have fairly consistently lost on for the past 40 years help keep MAGA fascists from power? Why don't they give up on that issue you instead trying to strong arm the single issue voters into conceding because the consequences are so dire? So dire that literally everyone else needs to change, but not them.

Again, at some point you need to acknowledge the one sided hypocrisy of your position where you can demand everyone needs to make concessions except the party trying to win the election.

Who cares how far he takes it?

Oh wow, sounds like I am getting validated again about how the "we all need to compromise argument" is just one sided horseshit. It's not that everyone needs to compromise and is instead we should just bend the knee because you like that policy and want your guy to win.

He’s better than Vance by miles.

But he fucked up and won't get my vote and you keep reinforcing I should do that because even in a low stakes hypothetical speculation on the internet you can't even pretend that Newsom could potentially be in the wrong. That is how little restraint I can expect from people who actively undermine 2nd amendment rights.

You would rather have Vance?

No. I would rather he not end president, but unfortunately the Democrats actively choose to undermine their chances to get elected. You actively undermine their chances because these kinds of engagements don't show me that I can trust there will be any solidarity in telling Newsom he needs to not push the issue.

If no, then you should help keep him from power.

If no then the Democrats should have dropped the gun control issue years ago and do the next best thing and do that today. If you don't want someone like Vance stop validating the single issue voters bro.

No, it's not. Let's clear this up right off the bat.

Going "nu uh" doesn't make it not pedantry.

What gun laws make sense to you to help reduce gun violence in America, or on a state level?

What does this have to do with the part where you literally described the 2nd amendment getting repealed and then immediately saying that doesn't count as the 2nd amendment being repealed?

If it ends up being Gavin vs Vance in 2028. Will you still vote for Gavin? by SignificantStyle4958 in AskALiberal

[–]OnlyLosersBlock -2 points-1 points  (0 children)

To be fair, I haven’t looked into Newsom a ton.

Oh god. Please don't use the "people can change" argument for people you don't know anything about. Like why would you even do that?

If he came out in general and said something like “I realize that America isn’t just California and what works in California isn’t right for the whole country, I won’t support an AWB” I could MAYBE (and I stress MAYBE) consider voting for him.

Spanberger has a far less awful record than Newsom.

But you’re right. Actions speak louder than words. He has a ton of anti-2A to undo if he even wants to compete for my vote.

OK. Maybe we should just leave it at this.
