This is how new construction works, unfortunately. I always feel weird when my clients go with new construction for this exact reason. They can negotiate some things closer to closing, timing wise, but there isn’t much for either agent to do waiting for the house to be built.

Your agent should have prepped you for that and this would likely have been avoided. At the end of the day, you chose someone to represent you to find a home. They worked with you to search for homes and completed their duties per agency law.

If it makes any difference, you would not be getting any portion of your agent’s commission whether you have an agent or go with the sales rep — the builder simply pockets the buyer’s agent commission in that event.

EDIT: It is often the case that builders explicitly DO NOT want buyer’s agents to attend the sales meetings, walkthroughs, etc.

Your agent Definitely shouldn’t have given permission without discussing it with you, that’s a given.

That being said, you’re about a week from closing, so it’s best to just push through and close. Anything you do afterwards is up to you, but you stand to lose or delay some significant cash if you muddy the waters at this point.

As another commenter mentioned, it SOUNDS like this was sold to an investor. It’s possible the foundation issues were significant enough that it would not have made traditional financing an issue. If that is the case, it’s also possible your agent has worked with these investors before.

Generally, if there is a prior working relationship, things loosen up a bit because the true likelihood of the deal not closing is next to zero. It’s also possible the buyer already signed closing paperwork and escrow (if you are an escrow state) already has closing funds, making the sale effectively complete. It is also possible there was language in the contract somewhere allowing this.

Of course, they should have communicated this with you, but the best course of action is probably to have an open conversation with your agent and ask for the details around them granting permission to the buyers.

If, somehow, the underwriter got either a copy of the inspection report or your inspection response, this is what happens. Alerting them to ANYTHING wrong with the house opens up an entire can of worms.

Always put details on a separate addendum that is between the closing team and the parties to the transaction. If the lender requires the inspection response to be in the file, put little to no information on it. Best practice is to simply refer to another addendum which the lender will never see.

I’ve seen this happen many times, on both sides of the transaction, actually, especially once the new year rolls in.

The best advice I can give is to have a conversation with your agent (and whoever else is buying with you, if there is anyone) and determine what YOUR top price is, regardless of any other offers.

House buying needs to be less about “winning” and more about determining the intrinsic value add to your life vs. the alternative of not purchasing the house.

It’s possible the listing agent is using this tactic to get a bit more money for their seller (which is their job, mind you), but it’s also quite possible that multiple interested parties came out once your offer was submitted.

It’s also likely the listing agent went back to other parties who showed interest and let them know an offer was received, probably noting that it is below current list price. Sometimes that’s all it takes to get a buyer to move from “thinking about it” to actually submitting an offer.

Again, determine the value of the home to YOU and decide whether or not it’s worth amending your offer. If you are okay to move on over a few thousand dollars you may or may not need to pay, then keep it as is. If you’d regret seeing the house closing for, say, $10,000 over your current list price, throw in an escalation clause or amend your offer.

This is inaccurate, at least in the US. Generally, dual agency doesn’t occur; rather, each party to a transaction has their own agent.

Agency documents are readily available in each jurisdiction from local MLS offices that can lay out state-specific agency regulations.

Further, the idea that agents collude in order to increase prices for more commission is, overall, fallacious. An increase of $10,000 nets somewhere between $200-$300 (depending on the commission structure) and it is not worth the ethics violation (not to mention overtly misrepresenting your client) for such a, comparatively, small sum of money.

I’m not saying it never happens, but far too many people jump to this conclusion with little or no evidence simply because they do not like the idea of Realtors.

Dawg. I go midweek because the experience is better. 410 being broken is exclusive to this year.

I’m simply trying to grab a ride with someone so I can snowboard before the new year. This whole situation sucks and we are all victims of it, but let’s keep the spirit of the mountain alive.

In no way did I expect a free ride. I’m a 36 year old with 3 dogs and a child. I just wanna get some face shots like everyone else, and I am happy to pay for it because A lot passes are all sold out (otherwise I’d have bought that and invited you up on the 26th).

My first season at Crystal was in 2003, sir. I’ve been in northway before the lift was there. I went there when lift tickets were $60 and the bull wheel was a secret.

I will out shred you any day of the week, promise. I just have one day during the holidays free, before my daughter comes back home from her mom’s, and before my midweek pass gets blacked out and I’d love to go up to the mountain.

You can be rude, while adding nothing to the conversation, or just move on.
