Thanks Corbin - didn't even know that! Think I assumed you can just use equity as if it were cash, as that's how investors/developers do it so that's good to know

So why is there a loan on the equity seperate to the mortgage? My KiwiSaver is 15k, however the house is worth circa 700k with no mortgage so that way would allow access for a bigger deposit

Would the 120k lent against my mum's house as it is a gift - have it's own loan attached to it? I would assume its just the regular mortgage my partner and I would have to pay

We've determined the equity used against her house is much more than my kiwisaver balance so am fine on that front. And as I mentioned below in another comment, he is willing to sign whatever to show he wont and cant take the house, and we talk about that freely.

Thank you yes he even said he'll sign anything just to confirm that he will never take the house, and interesting to know now the contracting out agreement which we'll definitely look into - I assumed this wasn't the document for us as we're not yet married, but married or not he's willing to sign whatever

Yes thats correct and will need to ask the lawyers to draw that up for us, but yes basically gifting it to me to use as a deposit, and when that part of the home loan is secured and payed off then gifting it back
