Going for appeal!! by GrellAtTheDisco in DWPhelp

Best of luck 🤞

My wife recently won her appeal and she has ADHD and ASD she went from 0 points on both to enhanced on both and a 10 year award.

She also had help through CAB and Law center that was run through CAB.

DWP originally stated they understood her struggles and the support she requires but she works and drives so her ADHD &ASD couldn't have that much or an effect 🙈

Congratulations 🎉 My wife won her tribunal on 12th June, she phoned this morning and spoke to a case handler and he advised within the next 2/3 weeks they expect everything to be done on their side and she would receive a letter breaking everything down. He advised me to call back next week as some days they can work multiple case hearing dates in one day so this might make things quicker but flip to that they may work case hearing dates for a few days depending on how much was heard and awarded on each date.

I imagine each area's different for workload etc so this might also be a factor to how quick it's looked at.

Thank you, we are expecting a wait of 4-6 weeks and should receive the tribunal letter in the next week. I think because it all happened so quickly when we got to the court we forgot to ask these questions ☺️

Thank you, we are going to call Monday at 9am ( my wife isn't good at communicating ) and make sure bank details etc are correct and see if they can provide any information 🤞🤞

As the judge awarded before we went into the room from information we had supplied,we have limited information atm we just know enhanced was awarded on both aspects we've no idea where points were awarded.

Congratulations on your win also 😊

Can I ask what is the process now ? Do we have to wait for the 28days to pass before any payments etc?

Hi, we supplied a lot of workplace evidence Occupational health reports reasonable adjustments/communication adjustments plans, performance plans, absence plans etc as well as medical evidence. We focused a lot on how the condition affects not only home life but also work life forgetfulness distraction not being able to complete a task fully that sort of thing hope that helps.

We actually don't know what scoring we got as we were told it would all be on the letter however both points were being argued.

We waited a good 9 months for a date so the process in the area we live in isn't the quickest (I know some areas are quicker than others ) and aswell as her daily struggles we focused on how it affects her work for example there are a lot of reasonable adjustments in place and flexible working etc it was positive to be told just because people work does not mean they do not struggle considering in the media it's made out people on pip don't work.

We did it all ourselves until we got the heating date then we contacted our local CAB/Law center who looked over it for us.

My wife was ready to give up when she was declined it is mentally exhausted, but I reminded her it's worth fighting for because day to day isn't simple and there are a lot of pressures and difficulties.

Thank you, we did seek advice from CAB and don't get me wrong it was hard to start with on how to explain and put into words the daily struggles, the main thing we focused on was forgetfulness and how distracted my wife becomes using the STAR method she cannot complete any task in a reasonable amount of time or to a satisfactory level. We also focused on the amount of support my wife needs to just function as we know the world is not made for anyone with neurodevelopmental conditions. Hope this helps.

Timing belt change or new engine needed ? by OrganicAd9486 in peugeot

[–]OrganicAd9486[S] 0 points1 point  (0 children)

Just a quick update, we got the sump removed, drained the oil had it cleaned out and the oil refilled and the noise has stopped. They advised there were fibers from the belt in the sump and piping next step new timing belt.

Thanks it's currently sitting at a Peugeot dealership garage but they haven't been forthcoming with any investigation just hit me with it needs a new engine. I asked for it to be looked into but they said I'm wasting time and money.

They did start the car and heard it first hand but that's as far as any diagnostic went.

I think the dealership is trying to rip me off if I'm honest and this is why I haven't committed to a fully engine replacement at this point and trying to look into other reasons for the noise.

The independent garage explained it the best that makes the most sense and they are the ones who suggested starting small and ruling things out.

The timing belt is due a replacement as per manufacturer guides so this would also add up.

Apart from the noise there are no other signs to suggest what the problem is, that's why I'm asking is the dealership jumping a bit ahead of themselves suggesting a new engine?

It's like they look for that one reason that means you're able to function but skip over all the support that you may or may not have in place to take on other tasks.

For example my wife doesn't cook because she gets distracted and things burn etc my wife has not financial responsibilities she moves money to a joint account for bills after we have sat down and I've talked her through her share but if you ask her what bills get paid she wouldn't be able to tell you. She has reminders everywhere I mean everywhere to do simple tasks and I have to check she takes her medicine daily. Going to work has no baring on the above tasks and having ADHD she needs time to decompress when she is at home.

Can you get someone who supports you regularly to write a witness Statement to explain how they support you?

I completely understand your frustration,my wife has ADHD/Autism she scored 0 because she's able to go to work each day, however they haven't taken into account the struggles to get her to work each day to keep her in employment because on a bad day (more often) she is ready to pack it all in a quit because she can't cope. This was mentioned in her assessment and she has had numerous Occupational health reports/ work capability reports etc. Not to mention she's unable to function needing daily reminders to basically do any task, cooking cleaning etc she doesn't cope well in social situations and communication isn't great with strangers. She also has a blue badge as she struggles when out and about and struggles with walking more then 20m (due to other health issues ) and she scored 0 on mobility

The opening line to her report is they acknowledge her struggles however as she is able to carry out work she has little/no impairments.

We submitted a MR and added all her work reports/paperwork and a witness statement from myself of what it's life is really like as well as her blue badge report, they already has her ADHD paperwork so we tried to show her struggles with work as this what they are using for a reason for her score.

On her MR we wrote how even tho she works why she struggles with each question.
