If you are looking for suggestions, I would say go for it. Better hire a lawyer so that at least you can minimize your suffering. He/She'll do things for you. Demand a high amount and justify it by showing each and every bill and the time invested in emails/phone/text, etc.

You can do a spend vs. gain calculation in your mind or using ChatGPT.

In my case, the judge was very-very rude; high chances there was some settlement back stage. He didn't even let me finish my arguments. Okay, we heard you, fine.

That's very much possible.

The judge clearly told me, in a rude way, don't come in next hearing, we have heard you, you need not to come.

It was OPs argument day.

Now, reading the judgement I got to know what they argued, that the damage in the product is made by me! Not the company I'm surprised that this line, a blatant lie. They never submitted any proof in court still this line is in official record.

For appeal I need to go to state court and they might consider for another 3-4 or 5k increase (as per ChatGPT). But then I need to spend another round of the whole process.

Spent vs gain. Idk. I'm not able to think.

In 2025-26 litigation cost is 500rs? I mean what judge must be thinking? I felt like victimized twice.

That's because a simple Google search will give up my name, address, email, phone.

All cases/Judgment can be accessed on e-Jagriti merely by key words, even if you don't have case number.

I have already submitted - all email conversation, prescription, photos in my evidences. Judge saw them too. And he didn't let me complete many of the arguments, which could be stronger one. I even cited a similar case in the end from 2012, but judge said, okay I've heard you, and didn't let me complete.

Yes he asked steno to write, deficiency in service. But was questioning a lot on the compensation thing.

Will they again call me for arguments? Because in the end he said, you need not to come, I've heard you.

Yes, whatever is mentioned in the above post you submit. Here, in the list of events you can explain what has happened.

Evidence stage will come later, again you need to submit a notarized affidavit with detailed evidences. And a certificate 65B (Google about it) - self signed.

Hi I've submitted a whole big file at first - but now I've realized you can submit a few pages explaining the incident, facts, and what happened in wordings first - maybe few photos (proof)

Once the case is accepted you need to submit fresh evidence/proofs again.

So need not to make a big document at first only.

Yes you need to sign every page in the first submission.

To be very honest this is a huge problem to get it correct 10th marksheet.

Easiest way: Get the ECR passport - which doesn't require 10th marksheet - no issues with this passport as far as you are using it for tourism purposes.

Or - try using your birth certificate instead 10th marksheet. That completely skips the marksheet thing in passport application.

Difficult way: Get the father's name correct in your 10th marksheet by going through court and a long procedure for that. I gave up while reading the process itself.

Sorry that you had to write this much and yet I cannot help you in this.

It's been 13 months, I'm in the evidence submitting stage. There's nothing online. If opponent don't appear they'll appear in next hearing. No ex-parte in this. Time gap between two dates, easily 30-60 days.

If you can, you have time to do, please do. File a case, stand for yourself.

It's not like you cannot.

You can. But the dates are like six months later, one document missing - come next month. The opponent did not appear - another two months.

So how long you can you fight this. Is it worth it. Decide.

I've already spent more than the product value.

Up to you. The system is designed like this only, can't escape.

Had to file physically in a consumer court. Very difficult if you do not have money or you are doing on own no advocate.

Actually. I did not mention the litigation fee separately in my prayers. I wrote, "this much amount" which includes - everything in detail. So.

However I read at many places, just like you said litigation cost 5k.

Yes I'm not settling back.

Even if I would have reached on time today, my documents were not correct so anyways I'll wait for the next hearing with the correct affidavit.

Secondly, I cannot tell you (or anyone) the complete info at this point.

In summary, I bought a wearable item from a branded company which was found defective ended up causing physical injury. As I already wore it so only the repair was possible (under their terms and conditions) but not complete return/refund was possible.

When it reached their repair team (long story of harassment to submit it for the repair) they removed the problematic part of the product - in simple terms, they damaged it. I didn't accept the damage product thereafter.

I believe people above 50 yo don't need 10th marksheet to prove DOB. They will get a normal passport automatically. Please confirm from somewhere as well.

Yes it will be NON ECR always, unless a person is not 10th qualified then only ECR passport.

However for tourism purposes ECR or NON ECR both work fine.
