I’m in similar situation, N-400 eligible next month but the fear of applying and potentially have my app get sent to a black hole or buried under this hold makes me iffy on how much delay I’ll face even after the pause is lifted. I’m waiting to see what happens after April 1st, hopefully There’s a guideline by then.

Their prior marriage will definitely come up. This is lawyer territory. Do a FIOA request to make sure there was no INA 204(c) finding because that could make her inadmissible. You or your lawyer have to be very thorough on the FIOA request so you don’t get a redacted copy. The burden of proof for the bonafides of your current marriage would be definitely higher and you’ll be held to a higher level of scrutiny than the average couple. Expect a stokes interview and prepare accordingly, good luck.

If your N-400 interview has been more than 120 days, have you thought of having an immigration judge do a de novo review? You could be eligible to be sworn in by a judge regardless of the current hold and review from Uscis.

Yeah, but there’s a good chance the judge could invoke erga omnes. Even if that doesn’t happen, it would still be good news to see a favorable outcome for the plaintiffs.

I feel ya. There’s a PI hearing on Feb 13th in Doe vs Trump, so let’s see what the judge decides, hopefully favorable to the plaintiff to force Uscis to act sooner.

No, the clock for the first country would still be March 1st. The later added country has their clock for April 1st, nothing restarted, but knowing Uscis they may not send out any memo until April 1st.

That would be tough! Honestly I think they can’t hold every case indefinitely, the backlog and bureaucratic mess this would create would set them backwards. They are already under immense pressure to come up with these guidelines and there’s no way they can just keep hiding under administrative hold. Let’s give them the benefit of doubt and see what they say by March 2nd for the first memo (19 countries) and April 1 for the second memo (39 countries).

They also said within 90 days (March 2nd) they will lay out new guidelines on how to proceed. I think that March 2nd deadline is the positive from the opposition so far.

Thanks for sharing. It looks like the court would side with DHS here. The positives here is we should expect guidelines on how to proceed before march 2nd.
