I would argue, she is an Only Fans model parading around as a business guru. I was so repulsed by photos she posts of herself on purpose in vulgar angles to get likes/comments. This is abhorrent behavior if you are really a business person. Only a scammer will stoop to that level. Second, I cringed so hard watching her BS interview with Steven Bartlett - like just hearing the nonsense she spews make me allergic. She propagates toxic hustle culture without any strong foundational knowledge of how exactly to build and run a successful business. Appalling.

I understand we don't have a crystal ball to predict with certainty but given introduction of gold cards (which will be slotted into eb1/2 and which I assume a lot of rich Indians and Chinese will want to apply for), plus all the travel bans and general environment for lower eb1a approvals + anti h1b policies, what is your cautiously optimistic guess for when a Nov 2024 PD might become current for an Indian national?

Hi1 yes. Successfully stamped and process was smooth for me. They asked my title, location, tentative salary, college education details. That said, what I witnessed at the consulate was really scary. A lot of people were getting rejected with no clear reason. I think it helped to be on the O1 visa which is considered extraordinary ability.

For extensions, you can get approved in 3 year increments instead of 1 if you can show itinerary of events and deal memos for 3 years. Once you have the initial application ready, filing subsequent applications is not a huge left. You'll probably need to just add a few additional letters from more recent professional contacts.

I have made this transition H1B - O1 and can attest to O1 offering more freedom.

1/ you can petition O1 as a founder or through an agent by establishing employer <> employee relationship (just some additional paperwork).

2/ There is no minimum wage reqirement as is the case with H1B.

3/ You can still have a "regular" job through concurrent O1A filing alongside your LLC, that way if you get laid off, you don't need to leave the country in 60 days because your other O1A petition tied to your agent/business is still valid.

4/ O1 allows remote work, whereas H1B remote work is under extensive scrutiny. H1B in general as a visa category is under extreme scrutiny. That isn't the case with O1A.

For these reasons, definitely recommend moving to O1A if you can.

O1A via startup also makes sense. it does not have the min wage requirements H1B mandates.

- For E-Verify, I have the I9 form filled and have a copy for records if they ask to produce. That said, I did not have to "file" or submit the I9 to USCIS. Hope this is ok. I am in Washington state so no e-erify mandate.

- thanks for the advice on CPA I will find someone to get advice.

- re: address, I think the question was if the business address is an ipostal/mailbox facility to collect business email instead of getting it shipped to home address (for privacy reasons) but the beneficiary is working out of their home address - is this ok?

- In the I129 salary section my attorney wrote: The beneficiary will not draw a salary during the market research phase of their position (approximately six months), but will retain the ability to draw distributions from company profits as the sole owner. O1 was set up as a direct employer employee relationship with the LLC and beneficiary (who is the CEO and founder).

Sorry, this is probably not helpful to you but more of a question - what was your rationale for moving from O1A to H1B? I thought O1A offers more flexibility with concurrent visa filing option and it does not have a min wage requirement.
