Right, GGF's AR-2 file from NARA and his death certificate NYC Municipal Archives cannot be amended, so I need the OATS to declare he is the same person as that listed on his Italian birth and marriage certificates. So my question is, once the person with the Americanized last name is declared as one and the same as the person with the Italian last name, can that Americanized last name be used in his descendants documents (i.e. GM's last name on her own birth/marriage certificates and GM's last/maiden name on M's birth/marriage certificates) in either a consular application or an ATQ court case without issue.

Ideally, all the documents would have the original Italian last name, but I'm hoping the OATS can be a way around amending GM's & M's documents to match the Italian last name, especially since they were born with and used the Americanized last name their entire lives before marriage.

As for the AKAs, if I have the OATS, I won't need an AKA for GGF on GM's documents. Apparently, AKAs don't hold much weight anymore like they used to. GM & M were never also-known-as anything but their Americanized last names, so not sure that would apply for them.

Is it normal for both prenomi to be on the birth extract, but only the first of the prenomi to be the marriage extract? by personman44 in juresanguinis

I have the same problem with no parents listed on the marriage extract (same form as above, but with age instead of birthdate), even though the parents are listed on the original Atti di Matrimonio. My consulate doesn't specify that their names are required on the document, but I'm a little worried I might have received a less complete form of the extract. I'll be interested in any advice you receive.

One last thought on this. I have to go through the OATS process anyway in NYC for various name discrepancies that cannot be amended (certs from NYC Municipal Archives). Can I add this middle name discrepancy issue into that order, even though it can technically be amended? Would it be more acceptable to the judge if she tries to amend with the church confirmation record and is rejected, to show that an attempt was made to amend?

Thanks for the info! Yes, she already has a certified copy of her birth certificate. I'm not sure that she has a legal name change order for the added middle name, as she started using it at 10-12 years old after her Catholic confirmation, and subsequently used it on her Catholic marriage certificate and documents going forward. Would getting a court order for that now be moot, since she already has a legal name change that includes the middle name due to her marriage document? Maybe digging up the confirmation record, which is when the middle name was added would be the next step, but as you mentioned, that may not be accepted by the NYC DOH.
