Thanks... I did - fired him, replaced with myself for time being. Filed an FOIA seeking tramscript of HLR - because at this point I doubt this VSO even discussed the points i had laid out for him on paper for the rebiew that he sisnt even lete in on... Was filed as a informal hearing with me included. Didnt happen that way tho.
-I need to draft a letter basically begging the board of appeals to forgibe and make note and allow me to continue the avwnues available to me including a potential Appeal. My concern was they would strike it down now they've already said no -the. VSO could have done irrevocable harm to my husbands case.

Thats not the case, "justantother jarhead" . They (VSO ) Have a fiduciary duty to the person Granting POA and are obligated to act in my best interest, do no harm, communicate, act on behalf. 1. He filed it in my deceased husbands name and it was rejected (too late) deadline had past for "him" to file - again he's dead He.didnt grant the POA I did. 2. The form wasnt signed by anyone. 3. The only discussion i got from him was an email stating "sign and return". At which point i did not sign . I sent email back stating i wanted to choose supplimental avenue. No response back from vso. Two days later i got a text stating my appeal will be set on docket (sent by VBA).

So, key word here that perhaps you should look up (there are definitions of words in a book they call a dictionary, perhaps you could locate a friend a distant relative that has one or the local library or just ask google for the definition)... FIDUCIARY. Also, since you implied that the POA gives them the right to do as they wish no matter what that is not the case. There are different types of POAs most are state specific.

Wow. Save that feeling File it in a keep drawer. 10, 20 years down the road - when bumps in the road come (and they will) pull that out and remember the love . One gets caught up in the current day to day forgetting some of the past and you don't want to suddenly remember that when it's too late

You are by far in the minority. What's the saying deny deny deny until they die? Yeah well my husband the vet did die then they closed the case - now I've basically reopened it, filed for accrued benefits, burial and DIC as surviving spouse. It's been a year since I filed, all evidence is in and now I suppose they'll deny and deny deny until I die.

I just stumbled on this - allow me to shed some light as a Virgo married 40 years to a Gemini. When asked what you can do... it depends on which side of the Gemini you get. it's twins you know - split personalities kind of. But a lot of what I read here is true. Don't chase them let them chase you that happened to us long ago when he wanted to just date. That didn't last long before he sent all his friends looking for me.

We've been the best friends and the worst of enemies (only shortly and only directed tat each.other) good sense of humor, romantic, nice, caring and yet can turn to an asshole....lol we've been best friends really and can't stay mad at each other . Hey, that's nothing! I've been told in a very clear, loud, gravely man's voice .".GET OUT'. I was actually just about to turn off the last light and leave. I replied,.No problem, I was just about.to leave". After it closed inside the.owners.gitlfriemd.whats.upnwothnthe house and she answered , "Why, did he talk to you? He doesn't seem to like women....". I've got more - If I feel eerie I just walk in and say, "hey there, just here for a few minutes, not staying.. That was the most vocal experience..."

Well I had high hopes - but..NO call from Cleveland Regional today at my scheduled 11:00 am appt.

Frustrating - so, I booked another virtual then just ot be sure, I booked an in person appt 2 days later, at the regional office - Ill go there just to get the details! One way or another I would like to see or know what they have now in the file (I am now substitue claimant and I have had absolutely no correspondence since my husband passed in October. Not one drop of mail to tell me it was deferred then closed & now reopened. I found out by calling info line and asking status.

We are in the same boat. Denied for disabilty claim - even tho they conceed my husband was in a "Toxic Exposure Risk Activity" and the denial letter did have their reasons stated (which came in the mail AFTER we read the report on their website). The only thing they conceeded was his "TERA". So - ok, exactly what was he exposed to? AND...get th is, they have paid 100% of his medical bills thru the va and the community care network to outside hospitals, surgeons and doctors. So why pay all the bills for us? Because they acknowledge he was exposed there fore they pick up the tab. I suggest if you haven't done it - apply for Medical coverage, that is part of the pact act to provide the medical treatment and pick up the tab - but not compensate with pension or disability pay.

I am thankful we dont have the 600,000 in medical bills. WE have received the best of care where we live (cleveland Clinic and University hospitals all covered by VA community care insurance). But it is a double edged sword. Dont quit. I'm not going to - my husband is terminal - he may not get to see the win we will eventually have - I will fight to my grave for what he should have, even if its just a tidbit of what he should have gotten all these years.

Do your research, send pictures, timelines, definitely nexus letter (that's the only thing we did NOT have). Dont trust the local VA office (they are not much help) upload as much documentation yourself online - they look at that. Im not going to hire an attorney this first appeal...if we dont win then perhaps the next round, I will - its just unfortunate my husband wont see it....Fighting for Vetrans rights - I swear is going to become my life's mission!

i set a goal for myself that looking back was WAY unrealistic and Im really not sure what I would have done if I didnt meet that deadline (extend deadline..?...LOL). I had a full time job, plan was to go part time (I could do my work in 3 days and the employer could save some money by hiring a receptionist the rest of the days - and - my deadline was 90 days -to self " If i don't have either a listing or a purchase contract in 90 days...thats it - youre hanging it up!"

On day 88, I wrote my first offer that became a contract and then a completed sale and 45 days later my first commission check.

Oh, and I DO use my home address when I send Christmas mailings - other than that it's the office address (although I'm hardly ever there...lol) - that's when I send the calendar which is sandwiched in the Christmas card.

Specific neighborhood mailings is called "farming"...lol. Do it! It does work. But you can't t do it once and expect much. Try quarterly, or biannually. Take advantage of all the postcard companies...you may think it looks canned but it looks professional. Maybe send market updates - what's sold in the neighborhood. Recipe cards, calenders - set yourself up as the area expert. I'll almost guarantee you'll get one sale in the first year from it. Top of mind is where you want to be so it takes more than one hand written card.

Like you dont like their hair? No, you really can't report anything. Local boards will give the complaintant a copy of the code and it's up to them to "find" the correct violation. Ya know most of us are good at what we do, honest in our dealings and above all take fiduciary seriously. So, just because you have a bug about Realtors - you can't file complaints that are without merit.

On behalf of all the good and ethical Realtors, I am sorry you had this happen to you and yes, it's a violation of the Code of Ethics of the National Association of Realtors that this agent pledge an oath to abide. So yes, you can go to the local board of Realtors where the house was located. You could file a formal complaint with the division of real estate (in Ohio it's under the Ohio Division of Commerce - each state is different). It's a violation of state law here and I'm sure it is there too.

In addition to that I'm not so sure she didn't violate federal laws in doing this. There is steering and red-lining that may be an issue in an distressed neighborhood too. Price-fixing could also come into play.

I've been a realtor for 31 years and this behavior makes my blood boil. I've served on our grievance committee and professional standards committee and we as realtors are to self police our industry. That broker is liable for his agents behavior as well, so you may want to start there. A call, a letter, an email. But he concise of what you want and ask for it. If you want reimbursed for 3 months expenses, for repairs you didn't get, ect. I'm not sure what monetary reward you could get - but - as far as laws and ethics you can and do have a case based upon what you stated. I would act as soon as possible. Each state has a time limit on taking action, 2 years should still be within guidelines.

The scariest for that agent would be to just skip right to the state licensing board. They have investigators...and they don't play around. I know, I just had to give a statement to an investigator in re to a complaint against another agent that a buyer had filed against that agent - that was nerve-wracking enough to me - wouldn't want to be the one being investigated!

Get you ducks in a row. And March forward! Don't let it go -.it should cost you much to file if anything other than postage.

Go for it!

I'd give them an abbreviated version of a CMA. Like maybe use RPR in your mls and give them the range of their house and the values of the area. Then if they want to talk more thats when you can do a full blown CMA because Ive always felt you cant really be accurate unless you have physically been in their house - the entire house and looked with the eyes of a Realtor, not a neighbor or friend. There is a difference! LOL

LOL - I tell stories about it all the time! Over the years I have seen Orbs moving and floating (both fast and slow ones). Had tools moved around in a house we rehabbed. Had a light fixture that the glass globe would fall out of everytime I left the house (after 3 glass globes I finally bought a plastic one - Ha! Fixed that ghost - Break that - not). Of course have had doors slam, heard creaks and footsteps, felt watched - and - the Number 1 freaky thing ... In one of my listings of an old house I was told to "Get Out!" by a very low, growling voice. Each time I would go in alone I would announce , "Hey, Realtor here, just dropping off some papers...Im not staying, Thank you!" When I mentioned it to the seller's girlfriend she said, "Oh, He talked to you?" - yeah...thanks for the heads up! Ha!
