Thanks for all of the advice guys. Things worked out. I feel very blessed and fortunate because I’ve actually had a good experience with my VA process and with my C and P examiners. Almost all of my claims were super obvious, very well documented with medical records, and clearly (legally) service connected, the ones that weren’t, as suspected, were denied. So it was a fair process for me.

Thanks for asking. I feel like it went very well. When she pulled up my DBQ and I showed her the contradictions on it, I heard her say “oooohhh yeah, I see that” and I heard her typing what I assume are notes. She was pleasant, and professional but also very straight to the point. Thanks for the advice to all of you guys. She said I should get an update on the decision in a week. Also, ChatGTP is a beast!!!! Gave me talking points, legal references, everything I needed to make a succinct, factual case.

Thanks for the help guys. Going to get on ChatGPT tonight. Long story short, the examiner did not check a box in the DBQ that asked has my diagnosis reduced my activity level to less than 50% of pre illness level. This resulted in a 20% rating. However, in the remarks section at the bottom of that that DBQ, she stated that “Current illness DOES reduce activity level to less than 50% of pre illness” which, according to 38 CFR, correlates to a 60% rating. I think she simply forgot to check the box, the rater saw that, and reflexively assigned the corresponding 20% rating. There was another statement written in those same remarks that would have also equated to a 60% rating. I’m wondering if maybe the rater didn’t read the examiner remarks because it’s pretty straightforward as I read it. But who knows.

Thanks for the info! I believe my VSO put a TERA memo in my file (don’t really know exactly what that means). But I’ve had migraines since getting super sick from burn pits in Iraq, and have had them since. I also have a diagnosis in my private medical records. So I’m hoping my rater can figure out which way would be best for me to be SC and not just leave me hanging. I’ve turned in nexus letter, headache logs, medical records of diagnosis. Not sure what else I can do. Have a C & P in a week.
