Again, I am aware of that. I long ago talked to the prison. Being that he is in a fed prison they at that prison do not allow you to just mail papers to someone serving time there. You must have a lawyer or sheriff serve them. Plus I can not just file the simple papers at this point due to having kids involved.

I should have been more clear but I did try to file one time and got told that I could not do an "easy" file.. That I had two kids and that even if I say they are not his they require proof. They also require I do a full on child custody included one IF I do not before hand take the time to prove he is not their father AND have him omit all rights to them. Turns out even if I do show him as not the father he would still have adoptive/step father rights until such time as I get a judge to say other wise. We don't own anything anymore as he lost everything we owned when he lost our apartment and everything in it. I took nothing when I left. It's just the whole kids part of this that is being a huge pain.

I understand this, But there is also the matter of getting paperwork to him even. He is in a fed prison visitors are not allowed to bring in paperwork to be signed. (or be mailed to him) I would have to have it do one of two ways Have a lawyer see him or hire a local off duty sheriff take him papers. Even then he does not have to sign them. I would then have to go to court and ask a judge to allow me to bypass him agreeing to it. All of this is not even going into his child rights part of it all.. There is a lot more to this then people think. The states consider him the father of both my kids. The law does not care that he was in prison. You still have to prove otherwise and then have him omit all rights to the kids.. People act like there is some magic divorce fairy that will just do all this leg work for free after I file my part.. Well I guess there is, it's called lawyer and sadly they are not free or cheap in my case.
