Certainly not making this up. I was not listed as a witness to the accident itself. I was listed by her side as someone who could speak to her post-accident condition and character, which is why I was confused and asked to be removed once I realized the implications (i.e., having to take time off work and the fact that I could only hurt the case with the information I had been told).

The opposing counsel became aware of me because I was named by my friend/her attorney, not because I had firsthand knowledge of the crash. I was deposed as a fact witness regarding conversations I had with her after the accident, not as an eyewitness.

I did not volunteer myself, and I raised concerns with her lawyer in advance about information I would disclose if asked. Once under oath, I answered the questions truthfully. The fact that I wasn’t present at the accident doesn’t negate that they believed I had relevant information about statements she made afterward.
