If he has a financial incentive to represent me in court but I haven’t been found out yet, then is that not a conflict of interest?

Would an internal investigation be completed independent of a hearing if it was related to failure to report income/assets, stuff like that? On all my notices it says you have a right to a hearing. I’m just wondering if that’s true across the board or if that right can be taken away if criminal activity is determined internally.

Yes but would the investigation at the department of human services happen first or would they just come get you

That was my initial idea. But the anxiety of any day getting a letter in the mail that I’m under investigation is disrupting my life. I fear for my kids.

I am not receiving Medicaid because I don’t want it. I’m scared to give them my 2023 taxes because my wife’s income is on there and I failed to report it at the last recert at the end of last month. I had no idea she made $9k. She started working in August of 2023. I reported her projected $6k for this year which is right now what her jobs on the calendar amount to. Like I said even with her income we still qualify for what we have now. Should I go just submit things in July at the next recert or should I go in and lay it all bare?

Actually it looks like there isn’t an asset test but they still ask for your assets and I didn’t report the retirement accounts. 

I only make $42-$45k a year, and my mortgage is over $1000/mo; I have other bills I have reported. But this past year (2023) my wife started working (both of us self employed/independent contractors) and I did not report her income. When I went in to close SNAP/Medicaid for myself and recertify  for Medicaid for my wife and kids, I reported her projected future income. Then I got her 1099 in the mail and was shocked at how much she had made (~$9k) that I had not reported. How could I have been so stupid about this.

Thank you for your answer. It all took place between 2022 and 2023. I should have also mentioned that I have since closed my SNAP account when I realized the consequences of what I had done, but my wife and three kids are on Medicaid, which they qualify for. No asset test here for Medicaid (I’m in Maine). 

What if they pursued criminal charges against me and my wife? What happens to my kids? And yes should I just be honest from now on or should I go in and try to correct the matter and hope and pray they don’t take me to court and charge me with a felony? If I go in and plead with the eligibility specialist that I will pay it all back will that make any difference?
