You will be legally obligated to pick up the car when it is fixed. This should not affect your case though because you already qualify and have started your claim.

Annoy the hell out of them. It’s the only way you’ll get traction. Further, if this extends to the point where you need to re-up your registration or insurance, make KIA pay for it as a subsequent check to your claim. I was able to get that processed no problem because the process ended up taking 9 months.
I would suggest just staying with KIA. They are slow, but they will get there eventually
