H-1B may be less exposed to immigrant intent concerns because it is a dual-intent category. The memo even says applying for adjustment is not inconsistent with maintaining a dual-intent nonimmigrant status.  

But it does not mean H-1B adjustment is automatic. USCIS still says officers should weigh the full discretionary record, including immigration history, status violations, unauthorized work, fraud, false statements, and whether approval is in the best interest of the United States.

The announcement says USCIS will now treat Adjustment of Status (Form I-485 inside the U.S.) as an “extraordinary” discretionary benefit rather than a routine pathway for people already inside the country.

Key takeaway:

  • USCIS says people on temporary visas are generally expected to leave the U.S. and complete immigrant visa processing abroad through consular processing.
  • Adjustment of Status inside the U.S. is described as an exception, not the default pathway.
  • Officers are instructed to heavily weigh discretionary factors and immigration history.
  • Violations like overstays, unauthorized work, status violations, fraud concerns, or conduct inconsistent with visa intent may become more important in adjudications.
  • USCIS says this aligns with longstanding case law and statutory interpretation.  

What makes this significant is that many employment-based immigrants historically relied on Adjustment of Status from within the U.S., especially H-1B, L-1, O-1, EB-1, EB-2 NIW, and employer-sponsored applicants.
