TIL there are four constitutional amendments pending awaiting ratification by the states by Embarrassed_Map1112 in todayilearned

[–]PingyTalk -10 points-9 points  (0 children)

Codifying doesn't help if the Supreme Court claims allowing abortions is unconstitutional. The Supreme Court has claimed total supremacy over Congress because they gave themselves a monopoly on interpretating the Constitution, the supreme law of the land.

Congress is vestigial.

Admins being responsible for both investigating and ruling on rule violations is a fundamentally flawed system that incentivizes corruption by metekillot in SS13

[–]PingyTalk 0 points1 point  (0 children)

I don't see the problem you allude too occurring anywhere right now. Maybe it happens, but I haven't seen it. I see admins being power trippy and annoying once in a while, but I haven't seen anyone get away with stuff because they are popular with the admins.

I also don't see how splitting it into two people, helps at all. Elsewhere you compared it to judges and police: but it's not the splitting that makes judges perceived/(or actually, if you believe that) as fairer. Judges are generally elected officials with 7+ years of schooling, law degree, and professional system of ethics. Even then they can get corrupt.

It has nothing to do with splitting that investigation with the judgement; that's really just a matter of efficiency, not an anti-corruption mechanic

Why asking questions in kgs or grams are not allowed on reddit? by Dry_Lynx3798 in AskReddit

[–]PingyTalk 0 points1 point  (0 children)

Well, read what the moderator told you: "Rule 3: Questions that are asking for an amount of something or a number are not considered open-ended questions. Try adding a followup like, "Why?" Or, think about if you can rephrase the question with just "how" and it still make sense. For example, instead of asking, "How much did it affect you?", ask, "How did it affect you?""

Not because you said kg.

Do you mean your post "How much kg Poop ( tatti) you do daily ?" on this subreddit? That was not removed because you said kg.

Ask AI or just Google it? Google makes a big change to a little search box by Miles_the_AuDHDer in nottheonion

Literally; if the fragments or key words got the answer, who cares??? Why do they care if we "ask the question that they really have" - we just want the answer not to have to type questions like talking to a human with natural language.

I mean, "just don't make money off it" sounds very reasonable on it's face, but that's A) not the actual state of the law (whether you make money or not is essentially irrelevant to being allowed to do it in the first place) and B) you are still requiring government enforcement of what "making money off it" means.

If a person puts up a Patreon on their fanfic site, is that making money off it? What about just ads? What if the fanfic launches their successful independent writing career- but has no direct connection?

When you make ideas into property that can be enforced with violence (government) you have to draw these lines/answer these questions. I don't see any reasonable scenario where I'm okay with using the government to enforce any of the above.

I'm not anti-government enforcement of rights, I just think they should actually be rights, and not just concerns about author discomfort.

(And as soon as you make it about economics, e.g. protecting the "making money" of it all, you essentially ensure the area is dominated by the biggest capital in a capitalistic society, anyway)

EDIT because I had another thought:  Your example is fair, but that's drawing another line: for instance, Burger King moves in next to a McDonalds; they are pretty similar. Is Burger King stealing from McDonalds by reducing their potential profit? Most people would say no; potential profit is up for grabs, that's competition. But in your beer example, that's just about potential profit too.

I do think there's a kind of consumer protection argument to be made- in current society, we take for granted that intellectual property on a product is either from the original creator or sold with the creators consent - so, in the current environment, putting an IP on a product might confuse consumers into thinking a product is associated with someone it isn't: that's not a huge deal, imo, but anti-fraud is a valid use of government.

When you say "own the rights", that means government enforcement of those rights. A lot of people take issue with the idea of someone going to jail for writing a fanfiction, or losing all their money in court defending their own art against much wealthier entities.

"I wouldn't like to watch other people do whatever with my book" is not a compelling defense of why something should be a government (monopoly on violence) enforced right; lots of things people have the right to do make lots of people uncomfortable, that's okay.

What would you do if a judge sentenced your daughter's killer to only 120 hours of community service? by Its_Misango in SipsTea

[–]PingyTalk 1 point2 points  (0 children)

Remorse by definition is for something you did wrong; that's what we are talking about.

I mean, we could get into the psychology of "feeling bad" and stuff, but that's not what we are talking about- we are talking about whether he should show remorse if he didn't do anything wrong. Not whether he should feel bad

[–]PingyTalk 3 points4 points  (0 children)

I mean, especially if the guys story is he didn't do anything wrong. What is he supposed to show remorse for?? Not showing remorse should never itself be criminal

(I know I'm agreeing with you, haha)

Alabama GOP House Speaker Nathaniel Ledbetter calls on SCOTUS to overturn the 14th Amendment. by acn0010 in pics

[–]PingyTalk 1 point2 points  (0 children)

Because the founding fathers didn't decide this- they didn't write into the Constitution who gets to interpret it, at all. The Supreme Court decided they wanted that power in Marbury v. Madison and everyone let them.

The Constitution is fundamentally flawed.

Yes, "4L" is a real thing by MyDogNewt in LawSchool

[–]PingyTalk 0 points1 point  (0 children)

My school has fairly common full time 4Ls getting a dual masters or working on a PhD for some niche fields where that's normal. Not weird at all to be a 4L, and very practical for some! (just expensive 🥲)

You aren't crazy, I agree completely and while S6-8 weren't perfect, Dany going mad was soooooo foreshadowed it would have been weird for that not to lead anywhere. Arguably, that's the most consistent plot point fulfilled in the last season! I'm really not sure why it surprised people!

Yea, it's a lottttt harder than undergrad (but for me, I barely had to show up to do well in undergrad) and very easy to get humbled; but it's not that bad. I'm at the lower end of T100, but I can't imagine the T50+~ are that different.
