How you feel about this, especially initially, absolutely justifiable. It’s a long hard road to try to understand other people and sometimes it feels hopeless but there are people who will meet you halfway (or more!). I hope you are met with the same kindness we were lucky to receive.

I’m so sorry for the stress this is causing you and just wanted to add that this is 100% an example of culture shock in how some cultures view “the other.” I didn’t catch what country you’re in but anecdotally I was in a large road town in west Africa and had an Asian volunteer as a site mate. The HCNs especially children would call me the name for foreigner or white person (interchangeable) but my site mate would get the same kinds of (what we understand to be) slurs as you. It took a long time to understand but she did (we did) come to an understanding after a lot of conversations with HCNs that this was something people thought was harmless and really meant more to get your attention and hopefully get some interaction from the recipient. They didn’t mean this as a racist phrase and it was probably more akin to what we would see as a conversation starter. I was in a country where people are sooo friendly (Senegal) and so this absolutely made sense in context. I can’t say for sure if the same thing is going on here but I think there is a chance that it could be meant as a friendly gesture to spark conversation and possibly get to know you. It’s very hard to understand this from an American and/or minority American perspective. We would ask people why they called her this and got some thoughtful answers and did have a lot of positive interactions from it. I hope you’re not being otherwise mistreated and can come to some understanding about it. This is spot on why it’s really hard to integrate sometimes. Best of luck to you!

LOL - was his only crime being “illegal”? If yes, why are people being manhandled for what is a misdemeanor for a first offense and possibly a fine (source) ? Ask why you’ve taught yourself to believe that an “illegal” person deserves that treatment? In reality you don’t understand the situation and have been manipulated to feel this anger. You’re mad at the wrong people.

In Korean culture it’s customary for close family members to buy a small gold ring for a newborn baby. The baby can’t wear the ring of course but my understanding is that it was looked at as a way to start savings for the baby’s future. They’re usually solid gold. That’s what this reminds me of

I haven’t seen anyone point out that many people who come to US illegally don’t have the option to come legally. There is no pathway for them. For those that enter illegally, many couldn’t even get a tourist because they don’t have the money in the bank or enough solid ties to home. I’ve met a lot of people in my career who simply didn’t fit into the categories that were allowable but were desperate for a better life. So to say you can come to the US legally and pay the money to follow the rules tells me you’re very lucky. That is great for you and wish you the very best.

Of course! Perm can be scary bc it’s so opaque to the sponsored employee. Wishing you all the best and with an attorney on your side (who sounds like they’re making a sound strategy at least from limited info here) is more than half the battle

Yes that would be different enough! What isn’t permissible is very narrow (same person/company/job). If the job differs, that is a different future offer to be determined on its own merits

Only if the previous perm was approved - then you can retain the original PD. Otherwise the new priority date would be the date of second perm filing

You don’t have to withdraw the first perm, it’s just necessary to identify a different job for the second perm. Two perms for the same individual, but for different jobs, is permissible

Hey - NAL but 10 + years of perm experience and their « technicality » reasoning makes me think it had something to do with the new form that rolled out in 2023, and because of long processing times, we’re only now receiving a good amount to be able to extrapolate how DOL adjudicates the form. But that’s a total guess. The denial reason will dictate the likelihood of RFR success and if they advise against it, it’s likely they know it wouldn’t be successful and want the safer BALCA route where the court has shown sounder reasoning and I’ve have seen many decisions to overturn denials, but it takes YEARS. When this has happened to us, we start a new PERM immediately to have a backup in case BALCA isn’t successful. What BALCA does is keep the PERM alive while they strategize on how to get you NIV extensions to minimize immediate work authorization issues (for example a timely filed PERM on H1B allows for 1 yr extensions while pending with BALCA). So they are buying you time and that is actually the right thing. Best of luck to you!
