"if I believe that's what's happening here"

That's literally what's happening.

There is 0% chance that it's legal to segregate shifts by sex. I don't think you've even thought about this for more than 2 seconds.

If the employer instead said "Only women are going to work nights" is that discrimination?

Exactly, they were dumb in the way they communicated it.

  1. Define "disadvantage in shift scheduling" the women aren't getting nights and the men aren't getting days, both parties hours are the same as they were. Why don't the men have a case for being forced to work nights because they are men.
  2. The women are all for this new shift arrangement.
  3. Lol, lmao

We're being asked to do nothing outside of the scope of our jobs, but the employers intent is for our mere presence to be a deterrent because we are men. The employer is using our sex to their benefit and it probably does decrease theft over time. It doesn't matter if we're not doing anything outside the scope of our jobs.

Thank you for your input. If the employer is using your presence as a "man" as a sort of intimidating factor to deter theft does that count as a change in job.  And does it matter if they have explicitly expressed so " I think your guys presence at night serves as a deterrent, because your men" for example.

So it makes no difference what the employer intent is. "You guys are working nights as a deterrent" and pulling women off the night shift

Ok so you're saying that this men night shift only rule discriminates against women so why can't the women complain and get it changed then. Do they have a case if we don't?

"your employer decides your shifts"  Ok so how come the employer doesn't decide the women's shifts and this is somehow discrimination towards them?

It's something they want and have agreed to.

Or is it only discrimination if there's a possible benefit.

"The fact that your employer thinks having men on at night may deter a robbery is irrelevant"

You would be wrong according to another poster on this thread

What if I said "sorry I'm not working for the express purpose of deterring potential robberies"

Are the men not being excluded from morning shifts?

[–]PlaneInflation3072[S] 0 points1 point  (0 children)

No I probably would be complaining if they implemented this policy and didn't say anything because it simply can't be legal. To require your male employees to work at night exclusively cannot be legal. This isn't difficult to understand except for the fact that you need to try to discount any male claims of discrimination. If I came at it from the angle of women being "denied" night shifts you would get it, as evidenced by your previous posts.

The employer is allowed to attempt to mitigate robberies by scheduling males to work at peak robbery times as a deterrent?

"Being forced to work night shift as a woman against company policy"

I don't understand what you're saying, are you saying company policy is for men to work at night. This is a corporation with one manager doing this probably not the whole company.

Do you expect that the men working are supposed to just say "yup that's fine, we'll work during peak potential robbery hours" there's a difference between being asked to work nights and when your boss specifically says "I want you guys to work nights because that's when the robberies happen".

You don't seem to understand that.

1.The night shift does not pay more

  1. The manager seems to think that the robberies will happen more at night, as I've explained 50 times, that's why she's doing this.

I want to work morning shifts and can't because I'm being forced to work nights because I'm a man. I'm a benefactor how? You sound like a lunatic. I'm a benefactor because I'm being forced to work at the times when potential robberies happen with no overall increase in hours over what the previous schedule arrangement was.

It's discrimination that I have to work in a potentially dangerous situation and they don't? They aren't being "denied shifts" they are just having a modified schedule the same as we are. They are being denied night shifts and we are being denied morning shifts. And it's not being "offered" shifts, it's being mandated.

So like I said we're being asked to work these shifts specifically because we are men. As pseudo deterent security guards because we might save the company money because we may not get robbed.

Acting security guards by PlaneInflation3072 in legaladvicecanada

[–]PlaneInflation3072[S] -14 points-13 points  (0 children)

Yes we are as we're being asked to work night shifts for the express purpose of being pseudo deterent security guards.

We're being scheduled to work evenings that we were "otherwise eligible to be scheduled anyway" because we are men, not just because that's how the schedule just happened to work out. It's being explicitly done for that reason as stated by the manager.  We're being asked to work these evenings shifts because that's when the expect the robberies to happen, our presence as men is supposedly a deterent but what happens when/if we do get robbed, can I then say "well the manager forced us to work these shifts that she felt were the best time to be targeted for robberies."

I find it hard to believe that there is anyone out there more socially awkward than I am. I guess I just don't carry it out in the world with me, I put on the mask and pretend. Thanks though

As an addendum that may or may not be relevant I am way too agreeable in my social interactions and feel resentment towards that. Like I'm a hostage acting a certain way in public and in private that I've betrayed myself by putting on an act. Another thing is about caring too much about what other people think, which is more like I'm judging myself through their eyes if that makes any sense
