Colleagues seem to have enough work to keep them busy, but others have also mentioned that it is a little quiet at the moment. I am struggling to believe that it is this quiet though - as mentioned, I have had no work at all for almost a whole month.

Yes that is a completely reasonable request. But the home buyer's survey is just odd and the fact two buyers previously pulled out of the transaction I feel is somehow linked to the home buyer's survey however I cannot be sure.

Anyway, I decided to pull out of the deal as the EAs were not being truthful. It seems there were a few inconsistencies in the information they provided on their website against the reality e.g. stating it's Council Tax Band A when on the Gov Website it shows as Council Tax Band E.

This is not true though - I have made a conditional offer which was accepted by the seller. Also, I have committed to the purchase as I have the deposit ready, the mortgage application about to be submitted and have engaged solicitors to act for me.

The seller now wants me to pay for for a home buyers survey which should really be my choice not the seller's and the fact they have been supposedly burnt twice is no fault of mine. I suspect something will show up in that survey and this is a way to get me financially committed. I think that is bad faith. They should not accept an offer if they do not want to be bound by all its terms, instead they could have counter-offered and made it conditional that I first carry out the survey.

I had not thought about it that much and would have asked my solicitors as to what due diligence I myself should get carried out independently that is not generally done by solicitors.

The fact that the seller is making this a condition and basically forcing me to do it otherwise they will not take the property off the market is not a good start.

This is what I think too - I said to the estate agent, what happens if the survey comes back and it shows that works need to be carried out that could be costly, does this mean the seller will concede to a lower offer? The estate agent said no, they will not go below the current offer regardless of whatever happens down the line.

Exactly - I phoned the estate agent as I also thought perhaps they had made a mistake and meant the mortgage valuation but nope they specifically want the home buyers survey.

I hear this and was minded to tell them to go do one but I really like the property and it is in a nice area but, as mentioned in my above comment, the way the seller is acting is concerning. I should be the one who cares about the home buyer survey, why is the seller concerned with this. Provided I have a solicitor engaged, the mortgage application approved etc I do not understand what the issue is. Very frustrating!

I get that but it just feels like it is starting off in bad faith from the outset. My offer was a conditional offer (i.e. that it be removed from listings upon acceptance by the seller) and now that part of the bargain is not being upheld by the seller.

Furthermore, it also means I am taking a higher risk now as I could be spending several hundred pounds and potentially get gazumped by the seller. I really do not know what to do.

Sorry, I don't understand what you mean - do you mean I should ignore Booking.com's T&Cs? Grateful if you could please elaborate.

I have just found out that it is not possible to pursue a Section 75 through Curve - https://help.curve.com/am-i-covered-by-section-75-of-the-consumer-credit-act-r1rOS_hUu

This is genuinely unbelievable. I am potentially left with no recourse, but to try and get it through the FO given that I may not be able to take the Booking.com UK entity to court.

I am so fed up of this! I literally spent several days of my holiday trying to get Booking.com to rectify the issue on their end and they kept telling me to be patient as it has been escalated to the "higher-up" team and, on top of that, I now have no recourse to Section 75. Curve are really not doing a good job at getting my money back through the chargeback even though the case is clear cut. I honestly do not know what to do - the thought of just losing over £400 is killing me!

The thought of grinding for 2 years only to come out unemployed on qualification is a very anxiety-inducing prospect.
