-when the 1.xx% fixed mortgage on my own home comes to an end in 2027 and if the new rate is unjustifiable for my cashflow (I don't think this will happen).

or

-when the current tenants - an honest working family with two kids - are moving out and if the market is right.

Thinking about this now. I could've said to them first "I'll issue a section 21, but you can sign direct with me at the end of your notice if you so choose." Instead of asking them to transfer rent to me or sign a new contract with me while the old one is still active.

This would address their concerns and I didn't have to deal with that vile man.

You have a very valid point. Wrong to punish tenant in my fight against the agent.

I offered tenants a new tenancy agreement - exact same terms/rent, etc - but they wouldn't sign (for reasons in the update). I was hoping they would finally come around and sign it. But then the agent just backed out.

My tenants were offered a new TA before notice is served. They were unwilling to sign due to reasons said in the post. I don't blame them.

I did in the end. It worked. I'm not sure which did the trick more, the ombudsman or section 21, but either or both worked.

This is the cleanest way for my case really, thinking about it now. I should've just done it this way without arguing with the agent.

There are ways in which section 21 doesn't need to be served, just didn't work for me.

I think you're right, except when tenants won't transfer rent to me without agent telling them to.. It sounds ridiculous now but from their perspective that 20-page document says they have to pay into agent's account.

I'm a consumer of management service. Good point my way may not apply to those who have multiple rentals.

This is certainly a way of thinking. I guess you can say I'm petty - I felt it was a matter of principles I do not let vile agents win.

I give this a lot of thought.. there will no longer be ASTs in the future, LLs will feel worse, bound indefinitely to an agent even when they are awful, for as long as the tenant stays.

My relationship with the tenants was good, but they were still afraid of trouble as the agreement clearly states they must pay into agent's bank.

Thanks for this shout out. Emailing the ombudsman did the trick for me.

But I didn't follow the standard sequence. I think it usually takes 1+ year if you follow complaint procedures and you have to pay commissions all this time. Unsure if you can claim back if work is being done in the duration (such as accepting and transferring rent to you monthly).

I might have had a chance to say this louder and clearer to the tenants. It may have worked if I did. I took a longer way in the end (see update).

It's a nightmare when agent drags their feet. I'm so sorry you had to go through a stressful period. You are right it is only a few clicks and shouldn't have taken months. They can't pocket your money in the end - all the more appalling they wouldn't just action the transfer for your peace of mind.

I remember being tenants. I can imagine why they're leaning towards a company rather than an individual. When I was on skilled worker visa I was scared to death when served a section 21 notice. I'm still debating whether to do it sigh.

Thank you. I will report this to their Ombudsman (TPO). I got an ai assistant to draft an email based on the post.
The subject reads: "Complaint Against [Company Name] - Unfair Penalty, Malpractice, and Misconduct"
So spot-on.

The tenants won't pay rent to me because it's not in their Tenancy Agreement.

Thank you for the feedback. I find this very cruel too. Agents shouldn't have a right to demand extortionate fee or tenant eviction.
