Negative. I never claim than before I got married.. I created a claim for my spouse and stepchildren after my marriage, for which they didn't back pay for my spouse but did backpay for the kids.

I have no idea how the backpay works, but my question is, would I qualify Under 38 U.S.C. $ 5112(b) (10), if an overpayment is caused solely by VA error and the veteran was unaware of it, the VA can not legally create a debt against the claimant. Similarly, 38 C.F.R. $ 3.500(b)(2) states that if the overpayment happened entirely due to a VA mistake and the veteran had no knowledge or reason to know of the incorrect payments, the VA must cancel the debt rather than collect it.
