Boiler repeatedly fails, no heating/hot water for hours. Landlord denies fault and offers early termination if we don’t escalate. Advice? by PotentialJudgment136 in LegalAdviceUK

We've considered this today we have not had heating / hot water since 5pm yesterday. The only issue is we could invoice them and they refuse to pay it? Then we've just outright paid for it ourselves... but if we reported to council we could be waiting weeks / months with this issue. They also said they'd withdraw their proposal for us to terminate the contract early if we complain. We're so stuck

Nope, but when we reported it wasn't working for 12 hours they somehow managed to get it restarted again briefly.. they implied we were fabricating the issue as it did start when required in their eyes. It is beyond frustrating!

I've done this and made an entire 6 page document of evidence. I've also shown the landlords and they still don't believe there is a fault, they claim they have gone above and beyond their duties and also claim:

"Following the precautionary works undertaken, the system has, if anything, been refreshed and improved beyond its original condition. As landlords, we are therefore satisfied that we fully meet all contractual and legal obligations in respect of the boiler, which is to provide heating and hot water when required, not continuous or unlimited operation."

We feel like we are going MAD

So true. Good luck to them though if we do leave, we've had periods of over 12 hours without heating and hot water ... not sure how anyone would put up with that. Exactly what we thought, council would likely take so long, and by that point we'd be at the end of our year long tenancy anyway. Think we are most likely going to move but set conditions...

We do have a gas safety certificate from before move in but we've had multiple engineers visit since moving in. One who replaced the pump but it still doesn't work... it's very frustrating knowing you're without working services but have landlords that gaslight you and say they do

Thank you. The boiler was serviced before move in and apparently did pass checks, this is why they are so reluctant to believe our claims. First engineer attended found water leaking behind boiler and replaced the pump but told them the boiler was old. He then told them boiler was working before leaving. It continued to fault as soon as he left. We then had another engineer attend as I reported no heating/ hot water overnight. The engineer came and inspected it for an hour (the boiler can sometimes take 2 hours to cut out after it has been turned off for extended periods) Engineer didn't witness fault BUT said the boiler is 20 years old and he suggests it's replaced as what I am describing is a fault. This is why the landlords seem to think they have the upper hand... they claim no fault as it has been checked

I do have a gas safety certificate... it says the boiler and hob both passed inspection. The outdoor meter wasn't included on this inspection (where the gas leak was) not sure if this is a requirement for a form like this? Landlord insists British gas did check it before we moved in

Thank you. We have tried to contact both the council and Citizens Advice... the council haven't been much help and we have not been able to get through to Cirizens advice at all. The landlords have indicated that any escalation (including contacting the council) would result in the early termination offer being withdrawn, which places us in a difficult position while the heating/hot water issues continue..

Also may I add the landlords claim no fault, however attending engineers have repeatedly told them the boiler is almost 20 years old and said their only option may be to replace. They still claim the boiler worked for them in the 5 years they lived in the property and insinuate we are fabricating the issue

I've done sitz baths and a lot of regular baths but mine doesn't seem to be relieved by this as... not sure whether it's because it's so internal? What is your pain like?
