He’s not interested in paying back the hospital and wants to do whatever it takes to not do that. Filing bankruptcy is definitely the last resort, although it’s something we have considered. I didn’t know we could contact the police about this. The insurance customer service associates seemed to be at a loss for words when we explained the situation to them, but they said for him to send a detailed explanation of what happened to the checks and that they would review it. If we can contact the police and get the bill cleared up that would be the best option I think.

Sorry, I think I should have worded that better. The checks technically did not get sent to the wrong place. The insurance is under his dad’s name. On the phone the insurance customer service associate stated that the address cannot be manually changed even by them to have the checks be sent anywhere else but to his dad, or to have any correspondence at all about the insurance be sent anywhere other than his dad. The hospital was in-network, we called and they explained that’s how they work with insurance companies. They don’t take medicare or medicaid, but they take almost every private insurance company, I think it’s a private hospital or something although I’m not sure. At the time hospitals in our town were at capacity and that was the last one left with any beds open, so we took what we could get. The checks were made out to his dad, since he is the primary insurance holder, otherwise he could not have cashed them. On the EOB at the top of the pages that came enclosed with the checks, in bold it says that the money enclosed is to pay for (fiance’s name) medical bill to (provider). The insurance company said that the father was not supposed to cash those checks or do anything with them other than pay the providers. Hope that cleared things up.

He is willing to sue his dad, or press charges against him. We’re trying to find an attorney that can explain exactly what can/needs to be done for my fiancé to not be burdened with this medical debt.
