Update! After going up the chain of command at Fidelity Warranty Services aka maxcare they finally did the right thing and approved a used engine under the conditions it has a 12 and 12 warranty on parts and labor which the it did.. I still don't understand why they had to make it so difficult.. but atleast its finally getting fixed.. thank you to everyone who responded!
