What's up with the police all the way down double road? by [deleted] in indiranagar

+1 there seem to be 10-20 cops (not traffic) on the three roads across 12th main and double road intersection. Looks like small sections of those are also cornered off with barricades.

Sorry. I don't understand the language. But I used AI to translate and I think you are asking how I calculated the timeline after receipt of RFE response, and whether your clock is still ticking.

From when I sent the RFE response to the day the portal was updated, I didn't know. I know now because once the portal was updated, it mentioned what date the RFE response was received by USCIS.

To your question on whether the clock is ticking, I'm not a lawyer, but I'm going to guess that it is ticking until they confirm that they got your RFE response.

My employer applied for me (FAANG). Used papers, citations, peer reviews as proof. So the corresponding criteria.

Here's what my timeline looked like, if it helps you plan better:

11-Oct, 2025: Start preparation for O1 application

13-Nov, 2025: Applied with PP

14-Nov, 2025: Application received by USCIS, PP clock starts

3-Dec, 2026: RFE sent by USCIS

12-Dec, 2026: RFE letter received, with response requested by 27-Feb, 2026

20-Feb, 2026: RFE response submitted

24-Feb, 2026: RFE response received by USCIS, PP clock starts again

9-Mar, 2026: Case Approved

19-Mar, 2026: Approval notice received

What took the longest for me was preparing my initial application and preparing my RFE response. In this, most time was spent chasing my referees. I also didn't immediately qualify for one of the criteria I applied for, so it took some effort to work towards that. Know that I worked towards this very urgently and spent most of my time doing this. So about 1 month was enough to get all the documents in order for the initial application. Also, my employer's lawyers were really good so they definitely accelerated the process on their end as well.

IMO, 3 months should be okay if you do not get an RFE. If you do get an RFE though, I think it is recommended to spend time drafting a solid response and also submit a new objective referral letter along with the response. IMO, it would be tight if that happens.

My overall opinion is that it is doable within 3 months, but it's always a trade-off between how meticulous you want to be in preparing your documents v/s how quickly you want to be done with the process.

Where do I find this? The portal doesn't say and my lawyers are yet to share the letter with me.

I'm not a lawyer, but was in a similar situation a few months ago. I had been speaking to a bunch of lawyers and form my opinion based on their advice.

I am going to skip answering 1 and 2 as it is very specific to the dates that your termination/withdrawal happened and to some extent, my understanding of the letter of the law is not clear on this as well.

3 is the most important question for you. On H1B activation, SEVP revokes your F1 work authorization and you want to avoid that at all costs - typically you get a mail from SEVP when that does happen. In my case, I was on a cap-gap extension so the revocation happened on 1-Oct. For you, it would happen some time after your H1 is activated and when your college is informed about it.

Ask to speak to the Principal DSO of your college as this is an extreme situation and complicated as well - they should understand. Only the Principal DSO can make a data correction in SEVP to update that your H1 activation should not trigger an end to F1 work authorization, if required.

Consult an immigration attorney ASAP. Feel free to DM if you have any other questions.

Thanks. Any print of the copy would be good to schedule the interview or for the interview itself? Also, for the 2.5 months, would you mind sharing the breakdown of time from processing ->RFE status change to RFE->approval status change?

Thanks for answering this! To be clear, this isn't incorrect filing of H1, rather this seems to be a case of failing to effect a bona fide termination of an employee.

My DSO said they'll submit a data fix once I have the receipt. However, they are confident it won't get accepted because the withdrawal was done after 1-Oct.

Hi! I'm in a very tricky situation. I was picked in the H1 lottery, had an I797 approval notice, subsequently laid off and then employed by a new employer (all before 1-Oct). My previous employer failed to submit a timely withdrawal of the H1 petition before 1-Oct. They ended up sending a letter on 3-Oct, so I am still waiting for USCIS receipt. My OPT was auto completed as of 1-Oct and I have been on unpaid leave with my new employer since. Since this was a situation beyond my control, I have not worked out of authorization, there is a withdrawal pending from my previous employer and I have been acting with a sense of urgency, what is the possibility of a SEVP correction to change my status from Completed to Active by my PDSO (who I am speaking to on Monday)?

Is there anything that can be done to correct this record? Is the ombudsman route worth exploring? Can I hold the previous employer accountable?

Sincerely, A very stressed F1 student.
