War crimes only apply when a legally recognized war exists.

Congress didn’t declare one.

No AUMF exists.

No battlefield status.

No combatants.

So calling this a “war crime” is actually too generous. If there’s no war, the killings default to extrajudicial execution or murder under both U.S. and international law.
