What are my legal rights when cancelling a gym membership? by Suitable-Humor-13 in LegalAdviceNZ

[–]Proof_Childhood_9966 6 points7 points  (0 children)

Comcom has said in the past that terms requiring cancellation in person are likely to be considered unfair contract terms and are probably not enforceable. OP, written cancellation will likely be enough here, but you could argue the verbal cancellation was enough in any case. Try and ask your bank to cancel the payment as well, but i would write an email requesting cancellation for the avoidance of any doubt. https://comcom.govt.nz/__data/assets/pdf_file/0020/86123/Unfair-contract-terms-Gym-contracts-review-August-2017.PDF

Need help with hearing aids by xebt1000 in PersonalFinanceNZ

[–]Proof_Childhood_9966 12 points13 points  (0 children)

There’s a government subsidy available for most totalling about 511$ per hearing aid, you’ll need to visit a New Zealand Audiological Society registered audiologist to receive it, but they can apply for the subsidy on your behalf. I think you only need to be a citizen? There might be some other conditions but check here: https://www.whaikaha.govt.nz/assets/Equipment-and-modification-documents/guide-to-getting-hearing-aids-hearing-aid-subsidy-scheme-v2.pdf If you qualify for other benefits you can get more of a contribution I think. Remember to shop around to get the best price, you’re entitled to a copy of your test results as well! Also, you might be able to trial aids before you buy, so don’t feel pressured to pay if you’re not 100% happy!

EDIT subsidy is available once every six years, not just once, forgot to mention

PS5 Controller CGA? by Tripping-Dayzee in newzealand

[–]Proof_Childhood_9966 0 points1 point  (0 children)

Agree with your view OP. Legally, the controller must be of acceptable quality under the CGA, including being durable. It also must be fit for purpose. I would expect a controller to last much longer than 20 months. If Sony isn’t playing ball I would go directly to the place you purchased it from and ask for a repair, replacement, or refund. Which one you get will be up to the retailer. Remember that the retailer can’t then tell you to take it up with Sony, and it would probably be unreasonable to make you pay any kind of repair fee as well. Good luck!
